Well, Illumina's patent expert wasn't aware of certain issues until a chance conversation bought them to the surface - and that seems to have been his only job, probably with substantial support, in a huge company. So these things will happen, especially in a complicated field involving a very small company with few staff. And, BTW, no-one seems to be "defending" management, just saying an agnostic attitude would probably be more realistic from all of us, none of whom know the full story now .... and certainly did not months and years ago.

Yes, although I have no idea of this management team's actual merits, I also know, having been CEO of an outfit employing 300 workers, that you really have to be in the room to appreciate what a team is or isn't doing and their responses to the challenges they face. For that reason I don't think I have ever publicly criticised the management of a company - after all, as you say Florida, they are usually the same team in authority when you picked the share! What I do tire of though is those on the BBs, probably revelling in all their experience as a carpet-fitter or shelf-filler, who are so sure they know what is going on and why it is wrong, without ever having a clue of what they would have done in the same circumstances. Grumble over, but a bit of humility from the know-alls would make every BB a better place.

My reading is that the judge has something of an ironical sense of humour (there's one big clue which no-one has commented on yet..) and that he probably knows that Illumina have been playing a slightly unfair game here - in that their comments that "cor blimey guv, we only just found out about this by a chance conversation" ring about as true as many of the Murdochs remarks in Leveson 1 - but without actual proof he cannot uphold the claim of abuse of process. When you consider the bigger game here, especially the fact that TF's engineers and lawyers must surely have been involved in an advisory role, in addition to the experienced counsel Premaitha have used in London, I find it had to believe this is as simple as we have been led to believe by the legal process we have seen so far. I have no idea what surprises lie in store but I suppose my intuition is that Illumina have had it a little too easy so far .... and that just doesn't smell right to me. No denying it's been a crap investment so far though and I'm really not sure whether I have the patience to see how this plays out over the next year.

Not sure "concise" is the right word for one of these submissions but, other than that, I agree. Better to be up-front and declare they might miss the deadline by a week or two than miss the deadline with no announcement. But, yes, the middle-men will seize their chance to churn stock.
