3. Documents Required
Production Operation Stage RKAB Requirements:
Administrative documentation.
Resource/reserve estimates by competent person (for minerals/coal) or person responsible (for rock).
Payment proof to state treasury (non-tax revenue).
Digital maps including:
Actual and planned exploration continuation.
Mining and land clearing plans.
Forest area usage if applicable.
Chief of Mining Engineering.
Reclamation guarantee placement 1 year prior to RKAB application.
Production and mining locations must not exceed Feasibility Study and Environmental permit limits.
Mining locations must follow approved plans.
Article 6 outlines the evaluation and approval process for RKAB submissions. The Minister or Governor must evaluate applications for Exploration or Production stages, including contract continuations, within five working days, either approving them or requesting corrections. License holders have two working days to resubmit corrections, with up to three rounds allowed. A final decision to approve or reject must be made within eight working days, and if no decision is issued within this period, the RKAB is automatically approved through the system."
Additional Approvals Required:
Even after RKAB approval, license holders must still obtain:
Forest area borrowing/use permits
Land rights settlements
Marine spatial utilization approvals, as required by law
4. RKAB "Transition" Period
In the event that the revision of the 2026 RKAB has been submitted through the information system but "has not yet" obtained approval by the end of the current year, the 2026 RKAB that was approved by the Minister or Governor prior to the enactment of this Ministerial Regulation may still be referred to and used as the basis for Exploration or Production Operation activities
