On the surface, today’s RNS about an Ofgem investigation into Smart DCC looks like bad news. The investigation concerns potential breaches of licence conditions related to giving undue preference to affiliates and not procuring services on a fully competitive basis.
However, when you view this through the lens of the 'A Better Capita' strategy under the new management, a different and more positive picture emerges. It's highly probable that this is not a surprise scandal uncovered by the regulator, but rather a legacy procedural issue discovered through Capita's own enhanced internal audits. The most logical explanation is that Capita has proactively self-reported this issue to Ofgem. This is a classic "kitchen sinking" exercise by new leadership, demonstrating a firm commitment to the "Better Governance" and "Better Company" pillars of their strategy by cleaning up historical issues.
The timing of this is crucial and likely no coincidence. The massive Smart DCC contract runs until September 2027, and the procurement process for its next iteration will need to begin well in advance, likely starting in 2025/2026. Competing for this critical contract with an open regulatory investigation would be a significant, if not fatal, disadvantage. By self-reporting now, Capita can control the narrative, accelerate the process, and ensure the issue is fully resolved and "cleared from the decks" long before the new tender process gets serious.
Therefore, my interpretation is that this is a managed, proactive step. The investigation will likely be relatively swift, as Capita has probably already provided the regulator with its internal findings and remedial action plan. While the headline is negative, this is arguably a long-term positive signal about the new corporate culture of transparency and a strategically necessary move to protect a cornerstone contract for the future.
