The word ‘negotiation’ doesn’t necessarily apply to either of the contract. He widened the scope of his reply to render it largely pointless. Telling you that negotiation are ongoing, somewhere, isn’t news - is it?

If confirming that they are just waiting for a counter signiture(s) doesn’t put them in a closed period - I don’t know what would?
