The settlement won't be calculated based on that of other cases. It will probably be calculated on a damages model of enhanced revenue or loss of licensing with a multiplier for wilful infringement. Therefore it's possible that in this case the damages will be "several times the highest ever patent awards the world has seen." How can you rule it out?
We're looking at a $20bn profit from this infringement on Samsung's part, so it could get quite exciting on the enhanced revenue model.
"Others have made the equally preposterous suggestion that Samsung has committed to spending $17 billion on a fab plant in Texas just to try and influence the court."
Is that really preposterous given what's at stake in this trial? I don't know about it being the sole reason, but if it can influence and reduce the damages, that could have given Texas the nod over other areas. Again perfectly possible and unwise to rule out.
Some people like to openly discuss the all the various possibilities, speculate and have a bit of fun thinking of it from all kinds of angles. I don't think there's anything wrong with that, unless they've bet their house on it. Usual own due diligence and sensible caution required.
