Agreement struck in Geneva centered on Beijing’s promise to speed critical mineral export licenses

A trade truce between the US and China is at risk of falling apart, as China’s slow-walking on rare-earth exports fuels US recriminations that China is reneging on the deal.

Getting the pact together in Geneva earlier this month hinged on Beijing’s concession on the critical minerals, according to people familiar with the matter.

The people say the US trade negotiators presented their Chinese counterpart, Vice Premier He Lifeng, with a demand that Beijing resume rare-earth exports. In return, the US would agree to a 90-day tariff truce. He agreed to the demand in the final hours of marathon discussions with Treasury Secretary Scott Bessent and US Trade Representative Jamieson Greer, the people said.

In the resulting deal, both sides suspended most of the tariffs they had imposed on each other—drawing cheers from global investors and businesses.

Since Geneva, however, Beijing has continued to slow-walk approvals for export licenses for rare earths and other elements needed to make cars, chips and other products. 

On Friday, President Trump, along with his trade representative, called out Beijing for not fulfilling its commitments. 

“China, perhaps not surprisingly to some, HAS TOTALLY VIOLATED ITS AGREEMENT WITH US,” Trump wrote on his social-media platform Truth Social. Shortly afterward, Greer said China is “slow-rolling” its compliance with the agreement, mentioning rare-earth minerals as a sticking point.

For He, Chinese leader Xi Jinping’s economic gatekeeper, the willingness to comply with China’s rare-earth pledges faltered after the US Commerce Department on May 12 issued a warning against the use of Huawei Technologies’s Ascend artificial-intelligence chips “anywhere in the world,” the people said.

Beijing viewed the warning as renewed US aggression, and complained about it to Washington.

Trump officials then told He’s team that the Ascend guidance was a restatement of U.S. policy, the people said, and that China needs to do what it had agreed to. Such messages have so far failed to sway He and Xi. Beijing has kept on stonewalling approvals of such licenses.

Earlier this month we attended a webinar hosted by Agility Robotics, a US-based manufacturer of humanoid robots used in warehousing and logistics. The company manufacturers its 4th generation robot, Digit, at its “RoboFab” in Salem, Oregon, where it’s ramping towards 10,000 units per year.

The webinar featured a presentation, titled “Tech Talk: Humanoid robots, from the warehouse to your house,” during which an interesting question was posed: “How do we make a successful robot? Is it humanoid or is it humancentric?”

It’s a timely question, and one that needs to be asked, considering the growing array of robot makers racing to develop the most humanlike robot, which is especially evident in the case of robot hands, which continue to incorporate more and more degrees of freedom.

Agility suggests the industry’s current focus on achieving humanlike dexterity may ultimately not lead to the most helpful solutions. “We have a lot of evolutionary baggage leading us to a very rigid idea of dexterity. A lot of five finger hands right now are largely animatronic and not that useful”, said Jonathan Hurst, Co-Founder and Chief Robot Officer at Agility Robotics and presenter of the session.

According to Agility, a lot of five finger robotic hands under development today look great but lack utility for industrial settings.

Rather, Agility believes that arms with tool change mechanisms and a variety of specialized “end effectors”, rather than humanlike hands, is the path forward for humanoids – a path the company is already trending down as evidenced by Digit’s own robust limbs and utilitarian end effectors.

Other teams seem to be working from a similar principle as shown by PAL Robotics’ TALOS, Pudu Robotics’ D7, Leju Robot’s Kuavo 3.0, and Unitree Robotics’ work on the Dex3-1 Robotic hand.

So – will the future of humanoid robotics be hands on or hands off?

In our opinion, likely a combination of the two. Agility – a first mover in the US humanoid market – raises some important points on five-fingered hands lacking utility in industrial settings. But what about applications requiring more of a nimble touch? For these, human-like hands may shine. Time will tell where true success lies as commercial robots take on more and more tasks.

In any scenario, be it fixed hands or specialized snap-on tools, the future of robotics continues to bode well for NdFeB permanent magnet demand. Ultimately, if a large portion of robots developed in the future come complete with an assortment of accessories for different tasks, as opposed to fixed humanlike hands, it could translate to even greater demand for motors, actuators, and rare earth magnets per robot than previously expected

Despite a 90-day truce in its trade war with the United States, China appears to be maintaining tight control over its rare earth exports – preserving a key source of leverage in future negotiations amid intensifying strategic rivalry with Washington.

As part of last week’s trade agreement in Geneva to temporarily roll back tariffs, China pledged to suspend or remove the “non-tariff” countermeasures it imposed on the US since April 2.

That has left businesses scrambling to find out whether that promise applies to China’s export controls on seven rare earth minerals and associated products, which were imposed on April 4 as part of its retaliation against US President Donald Trump’s “reciprocal” tariffs on Chinese goods.

Magnets made of these heavy rare earth elements are an essential part of everything from iPhones and electric vehicles to big-ticket weapons like F-35 fighter jets and missile systems. Yet their supply is completely dominated by China.

However, there’s little sign to suggest China is removing its newly imposed rare earth export control regime. If anything, according to experts and industry insiders, Chinese authorities appear to be strengthening implementation and ramping up oversight.

Gracelin Baskaran, director of the Critical Minerals Security Program at the Center for Strategic and International Studies (CSIS), said China’s export licensing regime is “here to stay” and “may stay for a long time,” allowing Beijing to retain its leverage in future trade talks with the US.

If the US were to turn around and renege on their tariff policy, China can easily withhold the required licenses, she said, adding that the licensing policy is dynamic by design, giving Beijing the power to decide which companies or countries can access its rare earth minerals and magnets at any given time.

What is the policy towards applicants from 3rd countries? Are they eligible in general?

Project promoters from third countries are eligible to apply for the status of strategic project as defined by the Regulation (EU) 2024/1252 providing that they fulfil the eligibility criteria defined in Article 6 of the Regulation. In particular, the project needs to contribute meaningfully to the security or resilience of the EU supply of strategic raw materials (see Annex 1 of the Regulation). 

In addition, the project should be or become technically feasible and implemented sustainably. Specifically, the applicable legal framework or other conditions in third countries provide assurance that trade and investment related to the project will not be distorted, taking into account, in particular, whether the EU has concluded a Strategic Partnership or a trade agreement containing a chapter on raw materials with the relevant third country, or Overseas Countries and Territories (OCTs), and is consistent with the EU’s common commercial policy. Last, but not least, projects in third countries that are emerging markets or developing economies have to be mutually beneficial for the EU and the third country concerned by adding value to that country. 

In assessing whether a project contributes meaningfully to EU supply security, we will also take into account who controls the undertakings involved in the project. To that end, aspiring projects must also submit in their application detailed information about the control of those undertakings.

How do you handle projects that span both extraction and processing stages?

Each application can only address one stage (e.g. extraction or processing). This is due to the different permitting processes in the EU countries and different permitting deadlines. In case of a situation where applicants intend to address different stages (which are linked) in a project, they should prepare different applications (one per stage) indicating their linkage in the project summary field (section one of the application form). 📉 China facing a 60% drop in #rareearth concentrate imports going into midyear.

In April, the US halted exports of rare earth concentrate to China. At the same time, exports from Myanmar to China remain suppressed since late-2024 when resistance forces took control of key mining sites in the country.

Unless the status quo changes, China is poised to experience a massive drop in concentrate imports in Q2 2025 (and possibly beyond) and consequently a drop in feedstock supplies to its processors and magnet makers.

China’s newly enacted export restrictions, which have bogged down its own exports of rare earths and magnets, are serving to offset the upstream supply shock for now.

As export license approvals start to roll in from June and more volume and fluidity returns to the nation’s export market, concentrate supplies could become increasingly tight if China cannot imminently fill the gap.

The EU's Critical Raw Materials Act (CRMA) does extend its reach to projects located outside of the EU, though the main focus is on securing a sustainable and diverse supply chain within the EU. Strategic Projects (SPs), even those located outside the EU, can be recognized under the CRMA to benefit from streamlined permitting processes, easier access to financing, and matchmaking with off-takers. This helps diversify the EU's raw materials supply chain and reduce reliance on single third-country suppliers.
