They may well have achieved their objective and survived the stages and procedures of litigation and now find themselves in a financially good position. As a shareholder, what the hell, who cares how they got there, they have done it. His judgement is solely based on Illumina having the right to proceed in defending their case because they have the right to proceed. A couple of points - as we now know the judgment was completed on the 19th, it would be interesting to know what was actually said by the judge at the hearing yesterday on the 23rd. Also steve67 made a very good point in that if the 10% escrow was ordered by the judge and is not a voluntary payment, it then becomes a potential in mind marker point for negotiations towards a settlement.

Thetinman - I do believe the price damage is already factored in to a certain degree. However, your right many who haven't taken on board our overall position will unfortunately misconstrued the true position and jump ship. I think the outcome will be greatly determined by the wording used in the bod's RNS tomorrow. They must be precise in what has taken place within these recent proceedings, but they also emphasize the importance of there position overall and leave no doubt as to the way forward. All biases aside, my strong belief is that in six months time we will be in an extremely strong position with the UK and Europe hindrance way behind us and a clear route to a larger market percentage.

Steve67 - if that was your 50k I have to make you right to purchase. The situation changes from one day to the next and the percentage chances of success have increased overnight. I would have assumed that if judgement was made against us yesterday, it would have been done and dusted there and then. I cannot think of any reason why we would have not heard news against us. It may well be that abuse of legal process has taken place which leaves the judge no alternative but to dismiss the patent infringement allegation. He is then in a position to induce a settlement.

Hemo - I'm sure it's right. Although, I can't find the diary listing for that day myself, I'm sure Brainspark would not use the word Judgement if he had not seen it. It is of course quite important to the chances of getting a settlement.

Not sure but I think the 321 litigation has already started. If it 's not thrown out on the first day, it's going to take a while. This then actually gives us a clear run up to the Finals end of March, which should give us break even and nice price rise.

I wouldn't be surprised Krull. I remember Chevron were completely into this kind of tech when Vialogy were talking deals with them. With any other bod involved the Chevron deal would have been a game changer. Our lot obviously left themselves wide open to be copied.

If Adam Reynaulds got wind of any skulduggery, I'm sure he would not be happy. His father is said to have lost a �9 million investment into Vialogy.
