Lithium royalty still 5%, new comprehensive guidelines on royalties to be laid before Parliament – Lands Minister
Speaking at a press conference on Wednesday, December 3, 2025, Emmanuel Armah-Kofi Buah, said the new guideline—developed in collaboration with the office of the Attorney-General will cover all mineral resources including lithium.
“Currently, the applicable royalty rate for mining operations including lithium as you know is 5% as stated by law. I am very happy to inform you that we have worked with the Attorney-General. Once we finish with Cabinet we will be coming to Parliament with a new Instrument that will permanently lay a complete comprehensive guideline on royalties not only in the lithium but in all minerals,” he stated.
“Ladies and gentlemen, I want to let the people of Ghana know that this government will not short change the people of Ghana, we have the responsibility to protect the interest of this Republic,” the Minister added.
The Minister’s clarification comes amid questions over Ghana’s Ewoyaa Lithium agreement. The Minister said an initial royalty rate of 3% to 6% was initially proposed before being amended to 5%.
Buah noted that although the law required an instrument to guide the application of royalties, such an instrument had not been in place, leaving the original 5% rate as the technically enforceable figure.
“It was amended and stated that royalty rate will be 5%. Then there was another amendment that says that it will be an Act as applicable by law. What was missing was that the instrument that should guide that applicable by law was never in place. And so, technically speaking what you could refer to was the original one which says that 5%,” he said.
The Minister assured Ghanaians that a new L.I will be implemented before any lithium agreement is entered to ensure value for money.
“We are working together with members of parliament to ensure that my new Instrument will really kick in before any approval of the lithium agreement so that the people of Ghana get all the advantages.
“We have listened to all the voices and we are taking steps to make sure that not only the project coming on but Ghana really gets value for money and the resources that God has endowed us with,” Armah-Kofi Buah noted.
