As I just posted before, I’m not too sure about this ROFR applying in all circumstances, mind, as opposed to a ROFL matching bid.

Hi CP - I recall that:

-Shaun informed us we have a LAST right of refusal on NCM's 70% stake in Havieron when a few peeps had been emailing the company and received a reply

- and that Newmont buying out NCM wouldn't result in an automatic opportunity to buy the rest of Havieron

Also thing that he general consensus was that:

- First refusal means you have the first option to buy the asset without anyone else getting involved

- Last refusal means that if the asset gets put up for sale then you can match the highest bid and purchase instead.

Just putting that in. No answers.

But I do think it’s been highlighted on here there was a difference between right to purchase as a result of Newcrest opposing a positive DTM ( can’t see why they would ) and a sale of their 70% under other circumstances, when it’s been said on here Ggp has the right to match anyone else’s final bid, and get the deal.

It might be important next year if it’s thought then that Newmont may dispose.

Wish I could tidy that up definitively.

I don’t think they’d need to go through that, would they? On a bid matching process, which I believe to be the case in a sale other than arising from DTM exercise (according to report from Dip) Wyloo and Ggp could buy the amount they each wanted from Newmont.

That info, I understand came from maybe a town hall or e-mail in response to shareholder(s)

We don’t know for sure he will raise, though I think this is the best opportunity to do so on listing on asx. Perhaps too good to be missed.

But we can’t judge any raise that might happen until we are given more information leading to a vote.

He won’t be doing it without the backing of major shareholders, so in reality we’ll have to take it as it comes.

Nothing fundamental has changed here in terms of company progress. Mr. Day’s plan has always been to bring H into production and FCF, to fund the rest. I hope that doesn’t change.

To be honest, I have a dislike for some of the ‘reasons’ put forward to excuse a failing share price, as I see it, when sufficient sustained buying would right all wrongs, real or perceived.

I know your theory last time we spoke was I think about it all being down to the market-makers. As if they care.
