OSG my recollection, was that the decision not to pay hmrc vat stemmed directly from the result. It's a bit hazy as I believe the actual result was known about quite a bit before we were informed. But it's really hard to say wether it was 21 days after. Regardless he was very clear about paying hmrc until the result was known.
Also hmrc applied directly to appeal to lower and it was refused this mean they had to apply to higher, from my understanding as the appeal was denied there isn't anything after, unless they made a significant error of fact there would have been no need or reason for 21 days to apply after the denial , it was pretty much dead. All imo,.not legally trained
