I have to say I’m perplexed with Richard Seeborg’s (Judge) ruling.
It would appear he has either completely ignored or not even read FRR’s legal team’s response dated 7 May. Seeborg correctly states that in the Cayman January ruling, Kawaley opines that “FRR has no realistic prospect of success”. But Kawaley contradicts/corrects himself in the Feb ruling, which FRR’s legal team mentions in their response.
Importantly they state, "Finally, the Cayman Islands court confirmed that, while it had
“discharge[ed] the Interim Injunction” granted to Plaintiffs, it believed that
“Plaintiffs’ appeal against that decision had realistic prospects of success….”
So Kawaley has corrected his initial opinion, but Seeborg appears oblivious to all of this and makes no mention of the Feb Cayman ruling.
The FRR legal team must be furious! Seeborg needs to restudy the evidence before him - typical of the incompetence of some of these judges! Therefore his entire ‘merits’ conclusion is questionable!
Happy for any of the legal entities on here to clarify…
