Now I would argue that the FM continues.
The starting of production at Zulu has no bearing on the FM
IMO the FM was issued because 3rd party events prevented Premier from fulfilling the terms of the contract, the contract was for a certain amount of tonnage per month.
Premier will not be in a position to fulfill any part of the contract until Q1 and as a consequence, the FM stands.
IMO starting production at Zulu does not and will not satisfy any terms of the contract,Premier cannot supply terms until Q1.
As I see it the FM remains in force until
Parties come back to the table and agree on terms
The matter is resolved by arbitration.
