What sort of "Landmark" case doesn't result in huge financial reward? Give me an example of a 'landmark' legal case that results in 0 pence being awarded and how was that 'landmark'?
I have friend who is an arbiter in the construction industry in UAE. He seems to think that there must be some serious analysis and debate behind the scenes, possibility of this being a land mark case, legally.... Not necessarily financially

How is this down today, i added up the buys vs sells on tye trade history for today, sells = 473,808. Buys = 527,045. Surely this should of finished in the blue?
The Gold mine.. It does intrigue me why this has lain dormant since the case started. It actually worries me a bit, in a way that if the Uzbeks did perniciously steal the mine and licence off Oxus, then why haven't they mined it? This may seem like a simple question, but what has been their net gain from it (ie the value isn't being realised as it's all still in the ground) ? Are they simply waiting for another company to move in/start themselves when all this is over, or is it because no-one will now touch them with a barge pole and they cant get the expertise? I partly agree with Adams that surely there's loads of expertise on the Russian side...why hasn;t it been mined, and Oxus' property been treated like the company was..Ie simply used, or ignored. Yes, but without a doubt, this process could easily be a lot shorter with lower case work per Arbiter, more cohesion between the 3, and basically a rocket up the system's ar*s... I bet this protracted 5 year marathon could easily be sorted in 2 or 3...I don't think the will, of means , to change is there. Like someone said earlier, it's a closed shop, with no-one effectively policing it, or wanting to change it., Ultimately, I believe the system has lost its focus on why it's there - to serve justice. It should also send out a message that the system works.. But the message I take from this, is that if you;re a small or medium sized company, which has been wronged, Justice is very very difficult to come by. Justice delayed/justice denied and all that. You can see why, with creeping expropriation especially , it would be a very difficult decision , and ery brave to decide "That's it, we're seeking arbitration". The system is Offputting, when it should be there to serve.
How are decisions taken at UNCITRAL? UNCITRAL typically takes decisions by consensus, rather than by voting. The basis of consensus is that efforts are made to address all concerns raised so that the final text is acceptable to all.
From what I'm aware they only need a majority verdict? Ie. 2 Arbiters to agree out of 3

The mines were in the name of oxus no? The question is not if somebody could mine it as there are an abundance of people from Romania to Russia that are corrupt and have the ability to mine it. That was truly the question. You state it has laid dormant, do you actually know that or just assume so as that's how it should be. As for the referral to military regime. I didn't say they are one, but they control one no?
You ask if the Uzbeks could have mined the assets. The answer is a massive no. The site has laid idle since it was abandoned. They do not have the capability to mine there, and the equipment on site is in the name of Oxus, and no one will repair this for them. It is not a military regime, by the way. Where did you get that from? I do not subscribe to conspiracy theories in the slightest here. The Uzbeks have no competence to be buying shares directly or indirectly. They are just restricted by their own incompetence. I also see no way they could have connections through to the arbiters, aside through their lawyers. There is no corruption going on here with the Uzbeks, I feel I could conclude very strongly.

Untill all the 3.51p shares are sold in profit or its worked to the accepted level for more profit. Vlad, I know you have always chosen to slate me whether I post fact or theory due to my history in aims....But. I'll ask you a question for a serious answer as I do actually respect the majority of your posts and do believe you are closer than I to the ground there........So to the question. Knowing how corrupt they are and knowing the military regime, do you think it would be in the slightest way possible that the assetts have been mined in any way shape or form, night or day and that the revenues would be used to settle. This may sound outrageous but would anybody be able to get close enough to know. or dare speak of it whilst being well rewarded
Ricky roman - I feel your pain. The whole process is a complete shambles. Arbitrators should be limited to how many cases they can take on at once and that way they would get their asses into gear. Perhaps a maximum of 3 at any one time? Then it wouldn't be in their interests to drag things on. Justice this is not.

2012, 2013, 2014 and now 2015 - four complete years and still no ruling.......its unbelievable and I cannot understand why. Yukos was a highly complex situation involving one of the largest oil producing companies in the world, huge political decisions emanating from both the Kremlin and Rosneft and..... its CEO imprisoned in Siberia. But this,.. a Mickey Mouse AIM listed company v a corrupt Central Asian Republic. How can it take four years to decide ?? I am now of the opinion that there is no prescribed period for these arbitrations. The three panellists (for want of a better word) flit from case to case, under no pressure whatsoever to make a decision and all the time hiding under the aegis of 'If we take a long time we will be seen to be doing our job properly' What a load of old tosh, three intelligent former lawyers do not need to spend four years studying the evidence to come to a decision. I bought my first tranche of shares in Oxus in 2007. When we went to arbitration I thought late 2014 as worst case scenario, now its going to be 2016......five years after we started proceedings.....I am well and truly p***ed off with UNCITRAL.
