XS Power Batteries of New York acquired Loxus in April and still trading as a subsidiary. Due diligence would have shown up all active and pending litigation and the final price paid would reflect that. So Cap-xx will certainly get its award though XS Power could apply to the US Courts for either a stay of payment to a later date or an order facilitating payment over a given period of time. Either way, will reflect well in CPX P&L account.

I have just emailed the case results to "Elon Musk" at Tesla and made him aware of the repercussions to Maxwell.
Just in case he didn't know.

ORDER granting 85 Motion for Default Judgment in favor of Plaintiff Cap-XX, Ltd. against Defendant Ioxus, Inc.
The Court:
a. finding that Defendant Ioxus is liable for infringing the patents-in-suit;
b. awarding Plaintiff CAP-XX compensatory damages in the amount of $1,237,717.37 based on a reasonable royalty under 35 U.S.C. 284;
c. awarding Plaintiff CAP-XX enhanced damages in the amount of $3,713,152.11 based on the trebling of Plaintiff's CAP-XX actual damages under 35 U.S.C. 284 for Defendant's Ioxus willful infringement;
d. finding that this case is "exceptional" and award Plaintiff CAP-XX its attorney fees under 35 U.S.C. 285;
e. granting Plaintiff CAP-XX leave to submit a motion for attorney fees under Rule 54(d)(2) of the Federal Rules of Civil Procedure within fourteen (14) days of the Court's Entry of Default Judgment. (CASE CLOSED)
