And more to the point - when they published the last set of accounts - gross margins were 59% and expected to rise as more production done in house...doesnt sound loss making to me?

Why on earth would they be doing that?
Maxwell must believe they are innocent so will be still selling CapX "clones" until the Judge rules accordingly. As an ongoing business they will endeavour to hold massive stocks to meet current orders and perhaps quite a few new orders after an adverse judicial judgement. That will assist in covering their legal costs. In addition they will almost certainly appeal any decision and so hold back on paying any awards due to the tiddler who may then agree a compromise. At the moment, I suspect CapX are gaining contracts on a loss making basis. Their accounts will tell the truth

If Maxwell has changed its approach to manufacturing so as not to infringe, isn't that more or less like admitting you were infringing?
Question is: how is the performance of Maxwell supercaps without using cap-xx IP ?

But there again wont this reflect the size of any award and the possibility of any ongoing revenue . I had thought that this case was the big one but now I am not so sure . I may be a technical amoeba but surely this point is relevant to ongoing CPX finances

It doesn’t matter the infringed the patent, the fact they stopped infringing suggests they knew they were and have stopped to reduce risk.
