“Another important innovation introduced by ANM Resolution 37/2020, was the change in the wording of art. 107 of ANM Ordinance No. 155/2016, which made the environmental license no longer a requirement for the granting of the trial mining licence , becoming a mere condition for its effectiveness, that is, the trial mining licence can be issued before the grant of the environmental license, but will only take effect after the mining company obtains the latter.
Finally, among the changes introduced by ANM Resolution No. 37/2020, we can also mention the possibility of extracting more than one mineral substance in the same trial mining licence; the exclusion of the mandatory prior inspection, by the National Mining Agency, for the concession of the licence, as well as the provision that the technical and economic justification be made through a simple declaration by a legally qualified professional.
Therefore, it is clear that the trial mining licence is a relevant tool for the mineral research phase, since the results obtained from it often end up defining the strategies of future research and mining works. However, the bureaucracy associated with its issuing process ended up limiting its effectiveness in practice.”
“With the innovations brought about by the recent ANM Resolution No. 37/2020, the issuing process becomes faster, dispensing with the need for prior inspection and privileging the self-declaration system carried out by the miner, all with a view to reducing the regulatory burden. Such measures, together with others recently adopted by the current ANM Collegiate Board, promise to contribute to the improvement of the Brazilian mining business environment.“
