Banbury Glencore contingent claim- 'no attempt to have it recorded' 'material contingent asset'
RRR has not even recognized the $15 million claim which might result from the arbitration award. A legal claim which has been made. RRR has not even filed a legal claim against Glencore so do you realistically expect RRR's auditors to recognize a claim not even made in a legal proceeding?
RRR has faults but this is not one of them.
To be clear RRR has filed no legal claim of any amount against Glencore. A claim, when and if made, will probably include actual damages, lost profits, and punitive damages. The passage of time will increase the amount of any claim. A long passage of time might eliminate any claim due to statute of limitations. There are many many variables, It is both 'blue sky' and a 'long shot'. A cash award from the arbitration in RRR's favor increases the likely hood of a possible claim against another party. DRC providing additional business opportunities to RRR may also negatively impact any future possible claims against other parties. There is much that is unknown by RRR's shareholders which given the fluidity and uncertain nature of current events is understandable.
