It is the department’s role to set the acceptable environmental outcome and ensure the proponent has assessed all the potential impacts of the proposed project. In setting these outcomes, the department would consider the projected environmental performance of the project, including any options that would provide better outcomes for the environment. The department may seek specialist advice on the suitability of proposed mining activities, particularly where new and novel technologies and methodologies are proposed.

The project’s EIS assessment report will be made available online at the end of the EIS process. There are various opportunities during the EIS process that the community can view the EIS documents and make comments and submissions on the proposed project. This includes the draft terms of reference stage (section 43 of the EP Act) and when the EIS is released for public comment (section 51 of the EP Act). The proponent must consider all comments or submissions received when revising their draft terms of reference and draft EIS.
4. How much weight is given to the most environmentally friendly option (versus financial or convenience considerations)?
If an alternate or potentially more environmentally friendly methodology or option is identified during the EIS process, the department may discuss the potential to implement this practice, option or methodology with the project proponent. However, it is the responsibility of the proponent to propose the activities and methodologies they wish to undertake as part of the project, including an assessment of avoidance, mitigation and management measures to limit the potential impacts of the proposed project. It is the department’s role to ensure that the proponent has evaluated and adequately assessed the suitability of all proposed mining activities and methodologies before making a decision on whether to allow the proposed project to proceed.
