So Twatcher - even if Phase 1 is ‘allowed’ to expire the obligations of the authority are still payment for Phase 1 within 30 days of the date of the contract. A contract is a contract. There is no legality/contractual ability about the U.K. gov simply being allowed to walk away without paying a penny. The only instance of phase 1 expiring is if they decide not to continue to Phase 2 however the validity of contract terms of Phase 1 still remains and U.K. gov’s obligations to pay us!
It would be pointless having a legal contract or one party can change their minds without any recourse for the other party. What would be the point of having a legal contract. Like I said previously BOD need to muscle up legally unless they have refrained from doing so as they have been assured that it’s not game over.

Phase 1 has expired ODX have said in the RNS - however looking at the contract I really feel Colin needs to explain in his presentation in detail as I cannot see anywhere in contract terms where/how it allows the contract to ‘expire’. A signed contract is just that a contract where both parties are contracted and legally obliged to carry out their parts of the contract.

Looking at the contract as it’s split into Phase 1 and Phase 2 I note that the U.K. Gov is currently in breach of paying ODX then the preproduction payments.It says ‘within 30 days of the date of this contract’ - 12th Feb 21 -did we get any money? . The amounts are redacted. However I seriously think that ODX BOD know that there’s still a positive outcome and want to remain on good terms here as surely their legal advisers would be advising that they make a claim and sue if they have breached contract terms and they thought there was no hope.

I don’t think that the BOD would volunteer an investor presentation if they didn’t feel that there was positive stance to be had here. Also worth noting before we even had a sniff of the DHSC gov contract the SP was in the 60/70 range. It’s not game over. Personally I’d be considering consulting lawyers re the U.K. gov. Seems we are not the only ones however other companies are taking legal action. I note that they continue to be in dialogue so perhaps they see there is positive potential still and want to keep things civil. At this level it has to be marked a strong buy IMHO. I think we will finish in the 30’s - a bit of panic and overreaction somewhat.. Even the market makers opened this at 35 - if the market really thought it should be lower you know they’d have taken advantage- it’s the mass panic sellers off which created the SP drop to this extent not the RNS content.
