Under seal:

Filing under seal is a procedure allowing sensitive or confidential information to be filed with a court without becoming a matter of public record.[1] The court generally must give permission for the material to remain under seal.[2]

Filing confidential documents "under seal" separated from the public records allows litigants to navigate the judicial system without compromising their confidentiality, at least until there is an affirmative decision by consent of the information's owner or by order of the court to publicize it.[2]

When the document is filed under seal, it should have a clear indication for the court clerk to file it separately – most often by stamping words "Filed Under Seal" on the bottom of each page. The person making the filing should also provide instructions to the court clerk that the document needs to be filed "under seal". Courts often have specific requirements for these filings in their Local Rules.[3]

Normally records should not be filed under seal without court permission.[3] However, Federal Rule of Civil Procedure 5.2 allows a person making a redacted filing to also file an unredacted copy under seal.[4]

The bottom line is clear, no one is quite sure where this is going until we get a new news update.

Argentina has filed with the SEC its Annual Report for Foreign Governments and Political Subdivisions. For the 1st time, the gov has acknowledged that damages related to the YPF exprop. case could start at $8.4bl if the presiding judge rejects its motion for summary judgment.

YPF CEO from Houston: “The lawsuit that Judge Preska presides in NY, is about to be decided. We will know if there is a trial. We are talking about a litigation in the U.S. about a bankruptcy in Spain that will be decided using Argentine laws. In the next few days, the outcome".

Topped up earlier today with another £5.5K. The gap at 747p filled yesterday (open from 24-27 June). Hopefully we are onwards and upwards from here.

Just noticed that USA short interest reduced to 879.41K shares on 08/15/22. Reduced by approximately 55K.

In the big scheme of things it's a relatively small buy but none the less, it's yet another confidence booster for us long term investors.

Accordingly, it wont have gone unnoticed by Judge Preska that Burford are funding The Equity Project. A groundbreaking initiative designed to increase diversity in the business of law. Right up Judge Preska's street I think.

A late start for me so only just read Sebastian's twitter account.

I particularly like the defendant's comment "which YPF views as erroneous - would have profoundly negative consequences for Argentine companies (and their shareholders) more generally, and for the Argentine capital markets".

Wakey, wakey Argentina. It's a tough world out there. You pays your money and you takes your chances. List a company on the US stock market and you play by their rules and not your own, regardless of the consequences. Costs or no costs.

It looks like Judge Preska is leaving all the doors wide open for the Argentinian Government, YPF and the Amicus Curiae. In doing so she is showing the American judicial system to be very open and understanding and fair. On reflection, this may be a good ploy by her in that all the information and positions of all concerned parties can now be considered - legally that is. As a result and on the outcome of the SJ, any possible appeals may find that with all the relevant information out there, that the American judicial system will be less than accommodating in the future and take less time to address those same appeals.

IMHO, Judge Preska has no option, "the law is the law" and she will have no other option but to follow the law. Hence, award damages to Burford on the grounds that the law has been broken. What seems to be going on right now is who's to blame for braking that law - indeed, who has been extremely incompetent. Obviously the latest gambit is a face saving and time delaying tactic which is being deployed to confuse all and ......... probably explains why much of this case information has not been made available in the public domain. Understand one thing, that big Argentinian political careers and reputations are at stake here. Some might say that "the money is just a distraction for these people" but obviously not a distraction for Burford.
