As someone who knows about these things, CPX will have a statutory period in which to consider the judgment and decide whether to lodge an appeal, usually 14-28 days from the judgment date. During that time NO COSTS ARE PAYABLE to the winning party and should they decide to appeal NO COSTS ARE PAYABLE pending the outcome of the appeal.
I am convinced that CPX will appeal. For a start, the legality of the patents was not an issue in this case as once a patent is granted that is proof of validity. The fact that the judge allowed this to become an issue is itself a strong ground for appeal, the only issue before the jury being that of possible patent INFRINGEMENT. It honestly looks like the judge and jury hadn't a clue as to the complex issues in this case hence a superior Circuit Court judge is needed to get a meaningful hearing. This is what will happen and Maxwell may well elect to settle the entire matter at any time.
