PORT IMABARI
Five of the 17 crew members of a ship on the Amazon River, anchored on the edge of Macapá , were confirmed with Covid-19 by the Health Surveillance Superintendence (SVS). In quarantine since Monday (27), this is the third vessel this year alone that have been identified with people infected with the new coronavirus.

Action by the MP-AP had prohibited the transport of ore
In a decision handed down last Saturday (25), after a request for urgent relief from the Public Ministry of Amapá (MP-AP) and the State Attorney General's Office, the Pedra Branca do Amapari Court ordered the immediate stoppage of the shipment of tons of manganese. , for a vessel located in the Port of Santana, as well as prohibited the removal of this ore from Serra do Navio, under penalty of a fine for the company Ecometals of up to R$ 70 million (seventy million reais).
The measure was necessary in view of the decision of Judge João Bosco Soares, of the 2nd Federal Court, to authorize the Ecometals company to take the manganese extracted in Amapá out of the country, an affront to decisions handed down in Public Civil Action No. 0016086-73.2009. 8.03.0001, pending in the Single Court of the District of Pedra Branca/AP, where the MP-AP obtained a favorable decision so that 50% of an amount of ore explored in the municipality of Serra do Navio be destined for public purposes, as compensation for the non-compliance with the Environmental Conduct Adjustment Term (TAC) signed with the company at the time responsible for mining in that region, as well as disregarding the decisions of the Interlocutory Appeal No. 1040661-72.20194.01.000, TRF1, and the Collegiate decision of the Single Chamber of the Distinguished Court of Justice of the State of Amapá - Interlocutory Appeal 0002849-52.2921.8.03.0000.
In addition to the immediate stoppage of the transport of the ore, the unloading of all the manganese was determined, due to the lack of licensing for the transport of the ore, with a penalty of a fine of R$ 1 million (one million reais/day), up to the limit of R$ $70 million, on the companies Cibra Resources S/A, Cibra Resources INC. Amazon Brasil Mineração Eireli and Brasmin Mineração e Ecometals.

In 1997, Indústria e Comércio de Minérios S/A do Amapá (ICOMI) ended mining operations in Serra do Navio, leaving piles of granulated manganese with 3.2 million tons of ore, as well as the tailings, containing more than 6.5 million tons of fine ore, totaling 9.7 million tons, according to estimates by the National Department of Mineral Production (DNPM).
In this context, and in order to seek compensation for the environmental damage caused, the MP-AP filed a Public Civil Action assessed under number 0016086- 73.2009.8.03.0001.
In the course of this action, specifically on July 30, 2013, a legal agreement was signed between MP-AP, the Municipality of Serra do Navio, Empresa Alto Tocantins and Empresa ICOMI/Tocantins Mineração Ltda, for the disposal of the ore residue manganese extracted by the ICOMI Company and ECOMETALS.
The agreement established the release of 50% (fifty percent) of the manganese ore residue to its owner, as well as the allocation of the other 50% (fifty percent) as a guarantee for compliance with the agreement and compensation for enviro

Ecometals obtains judicial authorization to resume manganese exports from the Port of Santana
In a hearing held on Tuesday (28), at the Court of Justice of Amapá (TJAP), on the presidency of judge João Guilherme Lages, businessmen responsible for mining companies assured members of the Public Ministry of Amapá (MP-AP), that the The municipalities of Pedra Branca do Amapari and Serra do Navio will receive R$ 4 million from the companies to compensate for the environmental impacts generated by mineral extraction and they will comply with the agreement approved by the Pedra Branca do Amapari Court.
This amount will be reverted to the benefit of the population of communities affected by mining. The amount was secured and the judge of the TJAP, João Guilherme Lages, in case nº 0003166-1622,8,03,000, decided to release the vessel with ore from the companies Ecometals Manganês do Amapá Ltda and Amazon Brasil Mineração Eireli.
The guarantee was given and documented by representatives of the companies Cibra Resources S/A, Cibra Resources INC. Amazon Brasil Mineração Eireli and Brasmin Mineração and Ecometals.Manganês do Amapá Ltda, to the members of the MP-AP present at the hearing: the attorney general of the Public Ministry, Ivana Cei and the prosecutors Rodrigo César, replacing the holder, prosecutor of Justice Wueber Penafort, who acted in actions on the matter. Also present at the hearing, State Attorney General Narson de Sá Galeno; and the State Attorney, Wellington Bringel de Almeida, one of the authors of the Action.
At the end of the hearing, it was agreed that Amazon Brasil Mineração Eireli undertook to deposit in court the amount of BRL 1,000,000.00 (one million reais) until June 29, with the attachment of the receipt to the records of the Process, as collateral, referring to partial compliance with the Conduct Adjustment Term (TAC) signed in the records of Public Civil Action No. 0016086-73.2009.8.03.0001. (Edcl in AglNt in the Interlocutory Appeal in Special Appeal No. 1.909241-AP).
The company also committed, within 15 days, to deposit another R$ 3,000,000.00 (three million reais), with the same procedure as the first payment.
about compensation
Prosecutor Rodrigo César, a member of the MP-AP who works in Pedra Branca and Serra do Navio, also explained that the amount of R$4 million secured is only part of the compensation, referring to the ore that was already in the Port for shipment.
For the manganese that is still in Serra do Navio, he explained that there will be other values ??for the benefit of the affected communities.
“This compensation will be allocated to the municipalities of Pedra Branca and Serra do Navio, which for years were exploited with the export of ores. We couldn't take a passive look at the situation. With the new agreement signed, we will be able to work together for the recovery of communities. In this way, the extraction is defined, as long as it is in accordance with what was agr

and Wueber Penafort, who signed the petition.
“The case seems complex. But with a simple solution, since the discussion refers only to the need to comply with a current judicial decision given by the TJAP”, reaffirms the judge of the Single District of Pedra Branca do Amapari.
In addition to the immediate stoppage of the transport of the ore, the unloading of all the manganese was determined, due to the lack of licensing for the transport of the ore, with a penalty of a fine of R$ 1 million (one million reais/day), up to the limit of R$ $70 million, on the companies CIBRA RESOURCES S/A, CIBRA RESOURCES INC, AMAZON BRASIL MINERAÇÃO EIRELI and BRASMIN MINERAÇÃO LTDA and ECOMETALS.

Justice prohibits Ecometals company from transporting iron ore stored in the Port of Santana
The decision of the single Chamber of Tjap, whose rapporteur is the judge João Lages, prohibits the miner from being transported outside the state. Under penalty of fine for Ecometals of up to R$ 70 million.
The measure was necessary in view of the decision of Judge João Bosco, of the 2nd Federal Court to authorize the Ecometals company to take the manganese extracted in Amapá out of the country, which, supposedly, defies decisions of Public Civil Action No. 0016086-73.2009 .8.03.0001, pending at the Single Court of the District of Pedra Branca/AP, where the MP-AP obtained a favorable decision so that 50% of an amount of ore mined in Serra do Navio was destined for public purposes, as compensation for non-compliance Term of Environmental Conduct Adjustment (TAC) signed with the company at the time responsible for mining in that region.
The process and decisions of the State Court
In a decision of TRF1, of March 17, 2021, Judge Gláucio Maciel reinforces that “the federal court does not have, effectively, attribution to interfere in a process that runs in state justice [...]. The impossibility of interference is also highlighted by the existence of final and unappealable judgments for the transaction”. (PROCESS: 1040661-72.2019.4.01.0000 REFERENCE PROCESS: 0000553-

The decision of the TJAP
The decision of the single Chamber of Tjap, whose rapporteur is the judge João Lages, prohibits the miner from being transported outside the state. An excerpt from the decision follows:
“In light of all the facts narrated and taking into account that the main action has been pending since 2009 and until today there is no type of reparation for environmental damage [...], but noting that there is a need to provide legal certainty in the removal of ores by companies aggravated, so that the appellant is not harmed, I see the best way out to carry out a new expert examination, with the participation of all interested parties [...], in order to define the quantity and quality of the ore and the corresponding amount for each one of the parties involved (process 0002849-52.2021.8.03.0000).”
And more:
“If this ore is taken away [...] there may be a kind of default in the state, since there will be no certainty of environmental repair and many suppliers, including dozens of dump truck drivers and workers, who are awaiting compensation for the services provided, whose only guarantee of discharge comes precisely from this stored ore.”
The MP/AP considers, to avoid irreparable damage to third parties, it is urgent that the Judiciary suspend the shipment […] under penalty of tarnishing the entire process and the result of the necessary environmental compensation […] after the ore is unloaded from the Port of Santana”, argue the Attorney General of the MP-AP, Ivana Cei; State Attorney Wellington Bringel, and prosecutors Fabiano Castanho, Rodri

TROGIR..
Ecometals and Cibra announce a partnership to ship manganese stored in Serra do Navio.
The Croatian-flagged ship Trogir Split, coming from China, docked at Companhia Docas de Santana (CDSA) this Tuesday (21) to ship 43,000 tons of manganese ore extracted from the Serra do Navio mines, also during the operations of Indústria e Comércio de Minérios SA (ICOMI). The operation is the result of a commercial partnership between Ecometals Manganês do Amapá and Cibra Mineração e Indústria Ltda. that promise to unlock the mineral sector.
This operation puts an end – at least for now – to a huge imbroglio that has been dragging on in justice for at least 11 years since new controllers of the old Icomi announced the resumption of mineral activities in Serra do Navio. Since then, an endless dispute over the right to ship the remaining stocks of mining assets began, while machinery and other industrial facilities were looted or succumbed to bad weather.
A judgment by federal judge João Bosco Costa Soares da Silva, of the 2nd Federal Court of Macapá, decided to authorize the shipment of cargo stored since 2018 in an area of ??Companhia Docas de Santana (CDSA). The decision also establishes a personal fine of R$ 200 thousand to the director of the organized port of Amapá in case of non-compliance with the measure. “It is not up to us to question here, only to comply with the court order, so within three days the ship will be loaded and ready to export the cargo to China” , said Edival Tork, current president of CDSA.
Representing Ecometals, lawyer Rubem Bemerguy told Diário do Amapá that the measure does justice after years of disputes in various judicial spheres in Amapá and Brasília, where the highest common Court of Justice ruled on the ownership of the stored manganese. “It was from our complaint to the STJ (Superior Court of Justice) that we were able to take this big step towards unlocking the mineral sector and we have confidence now that there will be no setback” , said the lawyer.
Caçambeiros
A group of cargo transport professionals was on duty in front of the CDSA since the weekend when the arrival of the ship to ship the ore was announced. José Araújo, who represents a category of approximately 30 bucket shippers, says that for almost four months this cargo of manganese was transported from Serra do Navio to the port in Santana, but that they did not receive their fees, still under contract with Briga do Navio. Brazil, which contracted the service. “We don't want to discuss the merits of those who have the controlling interest in Icomi, but rather to be paid for our service” , he said.
Questioned by the report, the representative of Ecometals said that at this moment it is not up to the company to settle a dispute involving third parties, but does not rule out that in future operations the class of Amapá truck drivers will be called to carry out new ore piles to the port.
