Whilst I admire sarkozy's desire to help the lemmings I can't help but note how his arguments shift to fit the facts, it was all a fraud, a figment of Pearl's imagination until today, now it is simply an out maneuvering by the big guns, I personally would pay attention to an honest altruist, but maybe not an altruist with am clear agenda.

I note previously that you have intimated that the whole idea of a JV was a figment of Mr Pearl's imagination. Now you seem to accept that there may have been a negotiation after all, and it may have reached a pretty advanced stage. Now, you seem to suggest that the other party have simply dragged the negotiation out, knowing that SMA will run out of money, leaving the Major free to sign their own deal with the Guinea Executive, once Conte renages on the deal with SMA or alternatively SMA goes out of business. Have I got it so far? Now remind me of your reason for being here? One might be forgiven for thinking you are a cog in the above strategy!

My understanding is tbT the parties spent several months drafting a contract and that a final draft was agreed. after waiting several weeks for the board of the other side to sign it, Mr pearl suspended talks.

Bordersman I don't really want to comment on S&G again. I am not invested in it, I was simply making the point that from QPP's perspective I am glad we no longer own QPP legal services.

Bordersman you are right in that if you are a firm who specialises in High Value work then these latest changes will not make a difference. The business unit QPP sold did not fit that description. I am not saying that S&G is a majority sub 5K damages business, I don't work there so I don't know. But circa 80% of claims are sub £25K, and the majority of sub 25k claims are sub £5k.

No Bordersman I wouldn't expect a S & G profit warning in the near future. The changes have not been introduced into law yet and there has been no commencement date. All I am saying is that if we had kept that business it would have lost a significant amount of value as the business model no longer works for new cases as soon as the changes are implemented. The last set of changes introduced nearly three years ago are only just starting to bite for PI firms. There is lag time. It will be shorter this time around as the whole process for low value claims has been streamlined and speeded up. 5 years ago a low value RTA claim would typically take 12 to 18 months from start to completion, with the introduction of the Portal this was reduced to more like 6 to 9 months. So when the changes bite this time, the effects will be felt much quicker. Historically EL/Pl claims would often take 18 months plus and where litigated could go on for 2 to 3 years + hence why we are only now seeing a consolidation and contraction of the PI Industry. When the new changes are introduced this will hasten the contraction, but will not likely cause further consolidation, imo.

Bordersman I think you are right, it is unlikely to affect QPP's profits from S&G's Industrial deafness claims. But the high volume RTA business S&G bought will certainly be affected, and massively. Fortunately, this is not our problem.
