Lawyers insist that there was no crime in the controversial transaction for the acquisition of real estate by the Pokrovsky mine company.

According to the investigation, in 2018, Pokrovsky Rudnik JSC (part of Petropavlovsk Plc) acquired a building and a land plot in Blagoveshchensk for 218 million rubles. At the same time, the real value of real estate is estimated at 119 million rubles. Thus, the subsoil user suffered damage in the amount of 99 million rubles.

According to the Telegram channel “Justice for Maslovsky”, the defense presented its position at the first court session. In particular, according to lawyers, there is no actual event of the crime. The transaction was concluded on the basis of a report by an independent appraiser, who claims that he received no instructions to overprice.

In addition, the transaction has passed all required corporate approvals. All members of the Board of Directors of Pokrovsky Rudnik JSC reported that Maslovsky did not put pressure on them. All the witnesses interviewed by the investigation do not mention that the accused instructed his subordinates or appraisers to inflate the real value of the object.

The materials of the case confirm that the very fact of the acquisition of real estate and its price were disclosed to the shareholders of Petropavlovsk Plc in a timely manner in the annual reports. At the same time, the reporting was checked and approved by the largest auditing company Deloitte LLP.

The defense also points out that the examination of the criminal case was carried out by two individuals who are not state forensic experts and employees of non-state expert organizations. In the conclusion of the forensic examination, numerous errors in the applied adjustments were revealed, which ultimately affected the final assessment of the value of the object.

The defense intends to provide the court with alternative estimates from reputable expert organizations that do not confirm the conclusions of the investigation about the overpricing of the purchased building. Based on the above facts, the lawyers insist on the termination of the criminal prosecution of Pavel Maslovsky.

It should be noted that following the meeting, the consideration of the case was postponed to April 5 this year.

But RB POG are willing to pay I guess they sell thier gold to GPB and the payment is generated then, however they are still british listed and are bound by the sanctions. Of course they could always de list and base themselves on the MOEX. Problem of selling gold sorted but how will that affect us share holders

I suppose one difference is none of us had direct shares in IRC wheras the share holders of POG would surely have to make decisions on what the BoD proposes. I wonder what some of the institutional investors think with millions at loss if they sell now, Look at how must old Constain Strukov struck off his billion fortune.
