The third party litigation funder is mentioned but it's a bit nebulous - "The Joint Administrators will review the legal position in relation to the award and any other potential claims in liaison with the third party litigation funder." Seems to suggest Calunius may still be on board to fund further action?

I don't think the administrator's fees come cheap either though.... ....but perhaps the lesser of two evils?

I hope Calunius fees and arb expenses don't swallow up too much more than half of the expected $14m (inc. interest) leaving enough to finance an appeal, if deemed viable. Failing that perhaps there would be a vote on whether to wrap the company up or find a new venture to pursue?

Bit of a discrepancy there, I'd say...

One might assume the majority of unpublished awards were in favour of the claimant company, and the respondent country were loath to advertise their shortcomings? So perhaps 80% or more of that 40% could be construed as a respondent win? Whatever, if the unpublished awards were factored in it would surely paint a different picture?

Just Google Credibility Consulting ICSID Damages Study June 2014 and you will get the pdf. It makes sobering reading in parts but remember that many awards never get to see the light of day so the results tables are likely to be highly skewed, IMO.

Calunius are not our lawyers. They are merely funders who paid the legal costs of our lawyers, Derains and Gharavi.

I think they could have amassed some tens of millions under the radar but not much more. Still a useful sum if we win big and relatively few of their people are holding them.
