Colorado voters rejected Proposition 112 in the state's first referendum on oil and gas setbacks.

9News called the race about 8:15 p.m. as results stood at 42.33 percent in favor and 57.67 against. It fared better in Larimer County, with 46.17 percent of the vote in unofficial results Tuesday evening. The measure needed 50 percent to pass.

Had Proposition 112 passed, Colorado would've had the largest mandatory setback in the country.

"I want every Coloradan to know that we are committed to developing our resources in a responsible manner that protects the environment and keeps our employees and communities healthy and safe.”

A University of Colorado online poll showed narrow support for the ballot question that was barely within the margin of error. A mid-October poll by Height Capital Markets found that 43% of respondents support the measure, while 47% oppose. Height Capital sees a 20% chance of Proposition 112 passing.

On Monday, Next reported that RS Energy Group produced a paper forecasting what oil and gas operations would look like in Colorado if Proposition 112 passed. The report stated that 61 percent of the minerals underground in the Denver-Julesburg Basin in northeast Colorado would still be accessible, even with the surface land restrictions of Proposition 112. In the popular Wattenberg Field within the DJ Basin, the report stated that 43 percent of minerals underground could still be accessed, even if future oil and gas operations were limited to just eight percent of the land above ground.

On Friday Hickenlooper, a Democrat, said he has already reached out to stakeholders and will sit down with them — and the governor-elect who will replace him due to term limits — before calling a special session.

Colorado Gov. John Hickenlooper on Friday suggested a special legislative session is possible to “minimize the unintended collateral damage” that could come if voters approve new limits on oil and gas drilling.

In an interview with CBS4, Hickenlooper said if Proposition 112 passes Tuesday, he’d meet with proponents of the measure, leaders in the oil and gas community and the governor-elect to decide whether a special session is required.

"It feels like they're trying to get through as many permits as possible before the laws could change in a few weeks," explains McNamara.

It's unknown when a decision will come down on the Martinez appeal, which claims the COGCC is legally required to consider health and safety first and foremost before the needs of the oil and gas industry when permitting. The COGCC appealed a decision that favored the six teenagers who sued the commission, including Xiuhtezcatl Martinez.

McNamara says community members have been attending COGCC meetings for several years and have felt largely unheard; that's a big reason that Proposition 112 came to be on the 2018 ballot.

"I think that we've been, for a very long time, dismissed, as we're on the fringe, we're extremists," says McNamara. "It's been a long fight, and I think it's culminated in this statewide ballot initiative because every other solution hasn't worked."

350 Colorado is now asking Hickenlooper to take action and postpone the next COGCC meeting until after the November 6 election, but the group is not hopeful that he will.

"Our hope is in his final moment as our governor that he would actually take an action that would stand up for health and safety of the people of Colorado. The request is he does something different for this hearing and asks the COGCC to finally pause their permitting process," says McNamara. "We expect that they have the meeting no matter what."

Jacque Montgomery, a spokeswoman for Hickenlooper, says his office is not aware of the letter but that postponing the meeting would be premature. "We believe it is best to continue the work as current law directs," says Montgomery.

If that's the case, McNamara says, families affected by oil and gas drilling near their homes and other community members plan to make a strong showing at the meeting and speak out about their experiences. She expects the industry will also send representatives to testify in favor of approving the permits.

COGCC Executive Director Julie Murphy referred our request for comment to Travis Duncan, a spokesman for the Colorado Department of Natural Resources. Duncan says the meeting has been scheduled for a year, and there are no plans to cancel it or move it to another venue to accommodate a larger crowd.

Highlands is in on-going discussions with various strategic and financial parties for the development of its West Denver Shale Oil and Gas Project. The Company aims to leverage its potential partners' capital commitments to develop the asset with minimal costs to the Company and retain a significant carried interest for all wells without dilution to its shareholders.
