Offset by the fact that Anavio allowed doubt to manifest, created by their delay to Finance and all over a measly £2.8m !!! You couldn’t make it up. The whole Investment case for Copl now hanging on the delivery of an RNS on time. Like / They don’t know the outcome right now !! Not like pressing the red button is it ?

I am personally expecting RNS WED or THU because if you are the Legal Team and have to include the amendments re Waivers to Senior Lender linking to Bonds re set (Major Change) then they’ve obvs communicated to Copl that they need 5 days yes ?

In doing so you allow contingency within that timeframe and thus it is more likely than not that they complete the work and ready for sign off all in good time before the 6th. They’ll go to the 6th if they have to of course but they may also be complete before that date.

We shall soon find out.

Given that the SP is dangerously low (CAd 0.04), it is incumbent on the BOD to offer a conservative Guidance within a decent spread to demonstrate / share their own confidence in the GGS over a set timeline. Better still would be to disclose a Target that would make us Cash Flow positive. Market is in the dark. Time to shine the light.

If you are Legal Team signing off on a deal as Big as this (Remember / not just the $3.5m / it’s all the Bonds are being set at 4p) then if amendments re Waiver with Senior Lender Covenant Tests are to be included / then you’re gonna give yourself max time to proof read and re submit. That’s why I say RNS tmoro or THU is distinctly possible if my theory correct.

“announces that it has entered into an amendment to its Senior Credit Facility providing a waiver of its covenant tests as of September 30, 2023. Â The waiver is conditional on closing of the Company's financing which has been extended by agreement with Anavio Capital Partners LLP to October 6, 2023”.

Maybe Senior Lender and Anavio pushed it to the end of the Timeline to come to agreement over the Waiver. Now time for Legal Team to tie up.

Agreed F1. Major changes occurred in 6 Sep RNS. If Anavio seek any amendment that results in disadvantage to Shareholders / then that puts 6 Sep in chaos and unworkable.

Simmo / I’ve just re read the 6 Sep RNS and tbh it is written in the first sentence re $3.5m Equity and absolutely everything in there was Actioned because of that ie : BOD changes / Senior Lender support / Biggest change being Art moving to Copl America.

So one would have to hope that Anavio simply need more time to tie up their legal end.

For me / All we need is a 3 Well JV to kick things off. Anavio aligned to increase their ownership as and when. They’re in a unique position. I hope the $3.5m lands but more importantly their Stake officially as majority Shareholder. Pivotal week. Very delicate. In the balance.

Well Dickbat. All I can do is hope that Anavio deliver by FRI. It’s in their hands now. If they deliver the funding and offer a sneak preview re Q4 guidance / then SP doubles. It’s very uncertain period.
