The AC comment from the investornytt article posted on here shows how our people have seen right through the façade, Tunisia saying the assets of 2 (not all 4) assets are ours and the Oil was there all the time in a different tank is just BS to try and get the claim thrown out. As AC S
says, it's strange they say these things after 3 years of denial, 3 years waiting for the ICSID hearing, strange how the Oil was drained from the tank and sold but magically appeared in another tank at the last minute.
The only settlement I can see Tunisia offering after reading "would also prejudice the Defendant's legitimate interest in obtaining the swift dismissal of the claim" is one that pays back on Oil not sold, but not on 3 years of lost revenue, damages to assets (they will deny it's their responsibility, tough cookie and all that), etc. So nothing that AC would accept, not after building such a solid case with multiple Lawyers, advisors, loss adjusters, etc.
The 'average' ICSID payout is irrelevant BS. It includes cases that were dropped - no payout, cases that were lost -no payout, cases that were settled before a decision was ruled - no payout, cases where claims were exaggerated - cut back to realistic, cases that included erroneous claims that didn't stand up in court - cut back.
Zenith's claim needs to be looked at from the perspective of "Based on ICSID statistics, investors receive near-full recovery (76% to 100% of the amount claimed) in approximately 21% of cases decided by a tribunal." because our case is solid, with no erroneous claims, no exaggerated sums. The ICSID panel should agree with everything in our claim and every penny claimed, just like ICC court did with the ICC-1 claim.
I'm happy to wait the rest of this year for the decision, meanwhile, Solar will get built, Solar portfolio will increase in size, Uranium permit should come through, Gas and Electricity revenue from Italy will increase. I'm not the least bit bothered that Tunisia want to try silly games with the ICSID and I hope ICSID will see right through it and throw the Library at them.
