NEW YORK – A US appellate court has revived a patent infringement suit brought by Illumina against Roche over non-invasive prenatal testing (NIPT) technology.
In a 2-1 decision issued Tuesday, a three-judge panel of the US Court of Appeals for the Federal Circuit reversed the US District Court for the Northern District of California December 2018 order that had thrown out Illumina's case. The decision suggested the trial court erred when it ruled that Illumina's patents were invalid and unenforceable because their claims were not directed to patent-eligible subject matter. The case was remanded, or sent back, to the lower court.

JERUSALEM, July 15 (Reuters) - Israel said on Monday it had received bids from two groups of companies to explore for oil and gas off its Mediterranean coast, falling short of expectations for more robust interest from major energy firms in its latest auction.
Israel's energy ministry said the new activity will help position the country as a regional energy hub. But the results were not much of a rebound from a disappointing round two years earlier when, again, just two groups placed bids.
The first group in the current round was made up of British newcomers Cairn Energy, SOCO International and Israel's Ratio Oil. The second consortium included repeat bidders Energean and Israel Opportunity . Together they offered to take 12 of the 19 available blocks.
Israel discovered in 2009 that it had large reserves of natural gas in the eastern Mediterranean, turning it into an energy exporter from an importer, and has been hoping to attract oil and gas majors to operate in its waters.
Energy Minister Yuval Steinitz said in March that Brazil's Petrobras was expected to take part in the tender. Reuters reported that Exxon Mobil, in a major policy shift, was considering bidding in the auction.
Neither name was on the final list.
Instead, Israel has been relying on small and mid-size companies to develop its offshore wells. Texas-based Noble Energy is the operator of two large projects and Energean already has operations in Israel.
A date for a final decision was not given, but should the bidders be granted licences they will have three years to explore and, if conditions are met, could request up to a four-year extension.

Illumina Wins NIPT Infringement Suit Against Roche's Ariosa Diagnostics

NEW YORK (GenomeWeb) – Illumina announced after the close of the market on Monday that a UK court has ruled that Ariosa Diagnostics infringed its patent covering a method for noninvasive prenatal testing.
The UK High Court of Justice, Chancery Division, Patents Court issued a judgment finding that Ariosa's Harmony cell-free, DNA-based NIPT infringes Illumina's European patent 1 524 321. The court also found the patent's claims were valid.
"We are pleased that the UK Court has again ruled in our favor, continuing to affirm the value of our NIPT portfolio and the significant contributions of the inventors in this field," Illumina General Counsel and Senior VP Charles Dadswell said in a statement.
Ariosa was acquired by Roche in late 2014. In a statement, Elizabeth Baxter, senior director of corporate communications for Roche Sequencing Solutions said that "Roche does not comment on ongoing litigation."
The win is the latest victory for Illumina's NIPT patents outside the US. In 2017, the same UK court found that Ariosa and its licensee, TDL Genetics, had infringed five NIPT patents licensed by Illumina.
In December 2018 the US District Court for the Northern District of California threw out a patent infringement lawsuit filed by Illumina against Ariosa, invalidating the two US patents at issue. Earlier, in January 2018, the same court awarded Illumina $26.7 million in damages for a different patent infringement suit against Ariosa.
The Illumina EU patent claimed "A fraction of a sample of the blood plasma or serum of a pregnant woman in which, as the result of said sample having been submitted to a DNA extraction, followed by a size separation, of the extracellular DNA, the extracellular DNA present therein substantially consists of DNA consisting of 500 base pairs or less."
In his judgement, Mr Justice Richard Arnold wrote that this claim was "not obvious," "not insufficient," and that TDL Genetics had "infringed at least claim 1."
Arnold also wrote that the defendants asked the Court "to make appropriate findings of fact to enable the issue of law to be argued in a higher court if necessary." Namely, they proposed the court find that "maternal blood and its contents are naturally occurring products." However, Arnold declined to make that finding.
Illumina said it intends to seek "all available remedies for the infringement," including damages, injunctive relief, and attorneys' fees.

Germany Plans Limited Coverage of NIPT for High-Risk Pregnancies

NEW YORK (GenomeWeb) – Germany's publicly funded health insurance system plans to cover noninvasive prenatal testing (NIPT) for trisomies 21, 13, and 18 for particular high-risk pregnancies only, according to a draft decision published today.
The document, authored by the Federal Joint Committee (G-BA), which makes coverage decisions for Germany's government-funded health insurance, contains proposed changes to guidelines that govern which pre- and perinatal services are covered by public health insurance. Invasive genetic testing, including chorionic villus sampling and amniocentesis, is already covered for certain indications under these guidelines.
"This is explicitly about the application of [NIPT] in pregnancies with particular risks," with the goal to replace, as far as possible, tests associated with significant risks to the unborn child, said G-BA Chairman Josef Hecken in a statement. "This is not meant to be about screening in all pregnant women."
According to the draft document, NIPT should only be used in women with a particular risk or to investigate abnormalities in individual cases. A statistical increase in risk, such as due to maternal age, is not considered sufficient to warrant NIPT.
The goal is to offer NIPT in order to reduce invasive testing, although NIPT reports will recommend to follow up on positive results with an invasive test.
Also, only NIPTs with demonstrated high quality will be covered. Tests need to have been evaluated in prospective diagnostic cohort studies, published in peer-reviewed journals, and have shown a sensitivity of 99.13 percent and a specificity of 99.95 percent for trisomy 21, a specificity of 99.97 percent for trisomy 13, and a specificity of 99.94 percent for trisomy 18.
In addition, physicians counseling patients on NIPT must be qualified under Germany's Genetic Diagnostics Act and according to guidelines from the Genetic Diagnostics Commission (GEKO). Resources to be used for counseling patients are currently under development.
Finally, patient representatives on the G-BA have suggested to make NIPT only available from 12 weeks of gestation. In addition, they have recommended that patient counseling should include resources that offer information about living with trisomy, for example, from families with affected children.
A number of stakeholders, including the German Medical Association, two German associations of midwives, scientific societies, test manufacturers, the German Ethics Council, and GEKO now have six weeks to comment on the proposal in writing, which will be followed by an oral hearing to discuss open questions.
G-BA plans to make a final decision in August of this year, which it anticipates will go into effect in the fall of 2020 after information for counseling patients has been gathered, and pending approval by the Federal Ministry of Health.
