gingerjim, as rhertig advised, there is no direct access to the judge for shareholders and my research suggests that he is right. Hopefully JC will get his meeting and we will all get a chance on voting to boot Rick and Chuck out!
I thought it was just a curtesy RNS advising the English courts that the company is under Chapter 11 in the US. I think they have to notify the UK Courts because Hawk is registered here. I might be wrong though.
Rangers Brighteyes and Oldearne I have put you on the list. Thanks for your support.
The whole idea of the Chapter 11 is to stop the bank calling in the loan. Rick and Chuck have taken that power from the bank and given it to the courts. All major decisions including selling off the assets have to be approved by the court.
I think the 2 stooges have 21 days to replay then the meeting has to be arranged within 28 days of that reply. So that's 49 days max from when the meeting was requested.

Total shares pledged so far is: 40, 234, 977. I am currently looking into the Chapter 11 Automatic Stay and whether Chuck and Rick can use it to hide behind with regards to JC's request to hold a meeting to have them removed. Whilst the "Automatic Stay" protects them from the banks and other creditors I am not seeing anything that they can use within it to refuse JC his meeting. After all, and here is the rub, they are still bringing in nearly $2,000,000 and month! So for them it's business as usual! Obviously we are all waiting to see what the company does next. If there are any more lurkers wanting to join the list then either mail me at: hawkishhawkers@gmail.com or let me know here. Strength in numbers peeps!
You are on the list mate. I will update everyone tomorrow when I have more time. Thanks for all the pledges! :0) I reckon we will have broken 4%!
My point is if we start giving all agents connected to Hawk some grief then they may, just may start passing on that grief to Rick and Chuck. Once people begin to worry about any liability coming thier way it might spur them into action. If we all just sit back then we will lose our money as sure as night turns day.
Maybe drop Richard Johnson at Stockdale Securities a line. richard.johnson@stockdalesecurities.com He is the Nominated Adviser in charge of Hawk. These guys have a duty to steer companies through the good times and the bad not just sit back collecting thier fee. I have expressed my anger with regards to Rick and Chuck and funnily enough Richard has gone very quiet!
According to an article I have just read by James Harlett we PI's between us own less than 7% if the company. The biggest class of owners are Institutions with over 60% of the company. JC and his associates own about 16%. In my attempt to rally support for an EGM I managed to get nearly 4% of shares pledged. I am just wondering what percentage of votes JC will need to get any motions passed at the General Meeting he has called for.
Wouldn't that be something. Stephen Gutteridge at the helm. I actually made a few quid while he was in charge. That news would bring in a shed load of new investors.
I certainly will if I ever get the chance to meet him! Great news but my worry is these two charlatans Rick and Chuck will be sheltered in someway by the Chapter 11 process. I hope I am wrong!
It doesn't look good. Nothing I have read about Chapter 11 and shareholders fills me with hope. From the statement filed by Chuck to the bankruptcy court, he and Rick seem hell bent on selling off the assets. Thank you to all those who have pledged their shares. We currently have just over 34,000,000 million pledged. I don't think we will get our hearing whilst the company is in Chapter 11 though. They don't have to respond to their main creditors never mind disgruntled shareholders. I don't mind accumulating though and keeping a list just in case circumstances change.
Did you win your case rhertig?
Thank you for the advice rhertig. What I don't get is the why. Why are Rick and Chuck trying to scupper the company and doing themselves out of a job. What do they stand to gain from destroying Nighthawk?
This is all the files relating to the Chapter 11 stuff: http://www.jndla.com/cases/nighthawk This is a link to the Judge looking after our case: www.deb.uscourts.gov/content/judge-brendan-l-shannon There is no direct email link to the judge that I can see but that makes sense! I wouldn't go trying to email a judge directly. That will just p*ss him off! At the moment I am trying to find a way that we can get our concerns voice legitimately through the court process. JC has been named as "disgruntled" shareholder in the proceedings and I would like to join him as a fellow disgruntled shareholder!
I will add your shares my friend but if you check out my Bombshell link the news is not good at all.
Here is confirmation that waterflood has failed and that Nighthawk management are trying to sell off all the assets. It would appear that JC is the only one trying to prevent that from happening. http://upshotservices.s3.amazonaws.com/files/d8140377-ca29-4044-ae31-5a7c3edfed58/684fdf3a-bb57-40e2-b7f2-ad677cb5b001.pdf
No1Scarlet yes I did. Very good article. It does seem that Chapter 11 can be used as a restructuring tool.
