Still can’t get my head around the fact that you can build a company for 20 years. Spend millions doing technical work and exploration. Build multiple business partnerships in multiple countries. Gain the support of investors who believe in the project. You can do all this and then some absolute ball bag of a man can come in from nowhere and potentially take the entire company and the entire sunk 20 years worth of future profits despite the fact we have funding and haven’t declared bankruptcy or insolvency and judges seem to think ‘yeah that’s fine actually’. I’ll allow this.’

Agreed re the oil and future Arsenal. This is the most confident I have felt since the NOMAD quit. A genuine feeling of extremely cautious, moderate optimism.

I don't like this new gospel which states that £2m is pocket change and to default on it is some sort of shameful embarrassment. £2m is not insignificant and if we were in distress and 'moribund' as our lawyer put it then we would obviously need further funding to service this debt. It absurd to conflate future operational profitability with cash flow. We are obviously a very asset rich but cash poor company which is why we were targeted by Hope.

Our defence states that irreparable and disproportionate harm to FRR, shareholders, local industry will come from a Hope victory. In contrast a temporary delay of payment to Hope and Outrider will be consistent with our original agreement for the loan and provide no material damages to Hope.

Our lawyer sounds like a right bellend here:

Presumably a liberally conscious 21st century with no oil or gas.

The main reading I'm getting from this new document:

1. Hope started the actions to liquidate the company, replace the board, and block new finance during the 2 weeks the new action has been pending.

2. Hope is trying to use the termination by FRR of the Cayman action as evidence of weakness in our case.

3. We are arguing that we changed forum because it was too costly and inconvenient. Also the action was dismissed without prejudice so cant be used against us.

The rest seems to be a reassertion of the case against Hope and his conflict of interest.

"In the two weeks that this action has been pending before the Court, it has become clear – through Defendants’ own admissions – that Hope intends to kill the patient to eagerly harvest its organs."
