Fully agree with your analysis. Hence why my opening line was to state that this loophole needs addressing, rather than a blanket removal.
And for that I dont have the ready made answer.
However, some ideas on working a solution could involve finding ways to identify what is genuine business to business use of small parcels by looking at VAT reg, Company reg etc etc ... all of which can be used as a sourcing code for transactions that are for samples or other similar reasons.
Customs Depts now have access to really sophisticated scanning technology, just like the new airport gear, and so using A.I can surely be developed to intercept en-mass consumables sent from the same location and apply an automated duty invoice to either the buyer or seller. Happens now with some items going to Northern Ireland that are suspected of being re-sold into the Republic. But before anyone wants to ripping this lot apart, I'm just saying ! There is technology now that will allow the authorities to manage a change in the rules to ensure duty is applied appropriately.
The main issue will be political rather than practical. But U.K public sentiment is definitely moving further right in respect of protecting our shores and our interests, it just depends whether it tips the balance against Charlie the Chav getting his 4 striped adidas trainers for a fiver !
But in respect of whether small or medium businesses should still pay customs on items for resale or OEM use, .. why not. My Company does. Thats not about being competitive, thats about tax avoidance and greed. If everyone has to do it, then guess what, everyone is competitive !
