Update on Litigation & Bankruptcy Hearing
Further to the announcement of 1 September 2015, the Company yesterday received notice that the lawyers for John J. Ellerton, C & J Resources, Inc., and C & J Pension Plan & Trust have moved to withdraw from representing each of these parties in both the bankruptcy action and the federal court action. Mr Ellerton's lawyer state the reason for the withdrawal is that: "Counsel's continued representation of the Creditors will result in violation of the Rules of Professional Conduct or other law." Sefton's counsel in these matters advises that C & J Resources, Inc., and C & J Pension Plan & Trust cannot proceed in either action, and will need to be dismissed, if the entities do not find substitute counsel.
