IMO, this can now only go in one of two directions as as far as i can see - INC presently have approx over £2 m in cash in bank so can continue.

If the claims of infringement are proved false before the lawyers get involved , then the SP will recover drastically and there will always be a good time to buy in after the event -but maybe not in the low pence but with reassurance that the sp can easily get back to above 30p sometime - and much more later.

If on the other hand this allegation goes legal, then SP suspension likely for god knows how long....with very little / no updates and no idea of outcome..and no guarantee of any money back!

Depending on your risk profile and your size of holding here ...should dictate whether you buy more now, hold, sell half at a loss ( hopefully buy back later) and keep other half as a gamble - get out completely.

Anyone have a link to any INC presentations / reports etc where members of the board discuss in detail their patent protection etc

This could be the patent regarding the formulation of the agent in the cream.

"To date topical administration of nicotinamide, whilst desirable, has not been successful. Here is my penny's worth.....

It seems the allegation relates to the actual "formulation of the Skin + Cell range of products."

I think it all comes down to whether you trust the BODs or not! I do , and to me the very recent M reorganisation statement that they intend to service all territory's in Europe as a whole rather than each individual country - supported this rollout delay and also supported the earlier heading of INCs RNS which was entitled "Skin + CELL Initial Launch Extended Across Europe"....so there is some kind of alignment there.

in fact Tim stated on record at the AGM that the delay was not connected to the INC product in any way....so i do believe that todays news , a challenge to their patent has happened recently ,since this the AGM.

If you look at Tim and Simons share holding in INC . Mr Tim McCarthy has approx 4m , 3.3% of company and Simon has 3m shares, at 2.6 % -= so they have also taken a substantial hit on their individual holdings and no one has provided any evidence that they sold out at 30p plus in July- so i take this that they are significantly down and this news was again unexpected.

Amazing that we initially had a approx. 75% fall in share price today in what the LSE have down as approx £25 K shares sold and 52K shares bought. If you look at them they are mostly very small trades, except one large 16K one (undisclosed) at 2.3p.

I take some comfort that they are trying to get through this challenge without resorting to legal proceedings - INC must surely have very tight patents in place - something that the big institutions such as Tyndall Inv. 18% ( 21m shares) , NWF Bio 14% ( 16m share), Unicorn 11.5 % (13m), University Bradford 9m (10%) would have wanted to see sight of, i hope.

Until we are informed otherwise we will not know but i find it very unlikely that INC would receive several orders ( their fist ever orders) from one customer amounting to 350,000 units without any guarantee of payment or recompense if M cancel the delivery.

The 350K order is worth approx £3.5 m to manufacture at £10 per unit and is worth approx. £14 m gross to INC.

In fact if you look back at INC previous RNSs

June 24

M stated that the original 50,000 unit order hadbeen doubled to 100K by M and that

"The additional 50,000 units are being manufactured and on track for delivery to Marionnaud in time for the September launch."

Therefore, I take it that at least 100k units have been manufactured and possibly more and all that needs to happen now is that M explains the new plan and direct INC about where they need them delivered too.

Just my opinion, so could be totally wrong but I'm still trusting INCs information that they have put out in their RNSs. GL all Vas

I asked the question as i see this payment terms (on delivery) as insurance that we should hit the end of year projected revenue targets, even if full rollout was not completed....and to be honest now M have decided to move from an individual country phased rollout to a faster broader European rollout - they

will need delivery of more units sooner rather than later IMO.

I think if M do not launch S+C by beginning of December then it will be in the New Year. A December soft launch to Ms legion of followers ( Serving over 7 million loyal members in Europe) may be a good start !

I have paraphrased some of this release. Capitals are my own.

Only a few days ago Marionnaud, the European beauty retailer announced its reorganisation of its management structure with the aim of “strengthening its position” in the market.

The reorganisation represents a shift from a market-based management structure to an integrated model across all the countries in which it operates.

Marionnaud has appointed Emilio Leon as Sales Operations Director, moving from his previous role as Managing Director of its business in Switzerland and Austria. He will now oversee and harmonise sales operations ACROSS ALL MARKETS.

Tatiana Anton has been appointed Shared Services Director of the Marionnaud Group. She will be responsible for managing shared services across all markets, focusing on implementing integrated, data-driven business solutions.

The company stated that it was implementing changes to “drive customer-centric operations and accelerate growth”, adding: “The new structure will enable seamless integration across all markets, with functional expert teams providing leadership throughout all regions.”

It reads to me that have made a strategic shift from a individual country market-based management structure to an integrated, unified team model across all markets in Europe.

The timing of this restructuring, alongside what Tim stated at the AGM a few weeks ago " While the Company awaits clarity on timings, it remains committed to updating the market with full details as soon as these are available" now makes more sense and what was just initially a 60 shop rollout to what the SEPT and OCT RNS stated headed " Skin + CELL Initial Launch Extended Across Europe.....s now planned to be expanded from the originally expected launch, to a broader product launch across the European retail network sooner than expected."

That's 1200 shops in eleven country's.

Maybe, now this European restructure has been announcement publicly by M, we are now clear for an update.

"Incanthera's Skin + CELL initial launch production order, together with previously advised additional production orders, totalling 350,000 units, will now be used for the wider European roll out for anticipated orders before the Company's current financial year to 31 March 2025. This re-affirms management's projected revenues for the financial year to exceed £10 million and for Incanthera to achieve profitability."

As an aside i notice AS Watson have now reached 8,000 outlets in SE Asia.

I'm reassured to hear about this restructure and can easily see how it would have caused a delay in the mechanics of the rollout - and especially pleased to hear M are now restructuring to take on Europe as a whole instead of eleven individual country's. GL Vas

Must go a long way to explain these comments in the 25 Final Results

So if FDBK secure this £5 m , this will only (at max) secure them for one further year unless they can increase their revenues significantly .

What is a plus is that the ICB, and hence the hospital that engages with FDBK will gain a surplus of £240 per patient referred minus what ever FDBK take form this as their service charge. So , you would expect ICBs / hospitals etc to go for this as its not only brings down their outpatients list / waiting list but also generates income for them .

The big risk is of course that even if the ERF is continued into the year 2025- there is always a risk that the Government at any tine will cancel the funding, and FDBK will loose all the new contracts they have built up - due to no one to fund them.

In that sense this ERF funding is a fickle and somewhat fake / temporary funding initiative and not intended to be long term.

My understanding is that between now and 31st March 24 there is a pot of money in place to reimburse any customer who chooses BLEEPA as their solution provider via the ERF.

I quote

"( Any hospital, or ICB in England ) with immediate effect be able to utilise this funding, by local agreement, to reimburse expenditure on the Bleepa technology."

....therefore, if the technology is as good as we All originally thought, and customers want it as we are told, then their should be a stampede to buy it anytime soon ....................if not, then imagine how hard it will be to sell it, if we cant give it away technically free now!.

If sales are low over next few weeks and months then game over for feedback IMO

I'm still unsure why FDBK need to raise £5 m for , as any sales are pretty much underwritten by government ERF until end of March 25.

Surely, KMK should reap the benefits of the new labour budget investment in the NHS equipment -including medical imaging devices and radiography scanners.

Its a modern day fact that no one can get through a hospital visit without at least one scan or investigation involving at least one, often several modern day detection / imaging technologies.

Yes, Todays RNS had very little to add other than dates for a presumably much larger rollout - yet to be announced.

Its quite clear from the AGM that INC., have no control over this rollout, and in what manner M and Watson decide to do it.

INCs job will just be to supply the quantities required. So on this basis I do not think there is anything underhand here other than a currently small company supplier having to wait on a massive customers decision making !

On that basis i will be buying if this drops further with the ( experience) and understanding that AIM is a game and the sp does need to move between fear and greed a few times - so someone can make some money. Often the fear is in absence of certainty, such as today and the greed will be on the confirmation news, sometime soon hopefully.

Now the loyalty members IMO is really interesting and can be a very fast way of accelerating regular sales. ....just need a small percentage to try the product at a members discount and then purchase regularly online in future.

For example if 100,000 customers from a total of 170 m loyalty members became regular users of just one S&C product per quarter that would be approx.. £3.5 m profit each quarter. Just from those who had signed up for a loyalty card.

The fun has yet not started yet and we have already had a rocket rise in sp and a crash LOL and have not sold a single unit :)

I found this article interesting in regards to Watson et al training staff , not just shop flor staff but their over 3,000 pharmacists.

I still believe that INC remain on track for end of year guidance , and profit ., as repeated in RNS three weeks ago.

One of the reasons, and the only reason is we know the company are paid on delivery - so reduces risk massively.

Todays AGM , samples of the manufactured bottles where out on display for all to see, and you could see how proud Tim was of this product, he also stated this latest decision to roll the product out wider across Europe was nothing to do with INC, and to quote Tim " all the manufacturing has gone absolutely according to plan, and on time and we are absolutely delighted....we could not have wishes for anything better"

The Simon quote was interesting about high end products needing to be seen face to face first, and once bought from a physical shop will probably be bought online AND that is where the volumes will come!!

The BODs were Very excited about spreading the risk / opportunity around the world, including Duty Free shops and other ROW territories.

Also i was pleased to hear that they will be extending the range of their offering , quote from Simon

" we are very much going to be bringing out a "sun care range" to include a pre and post sun product!!

If they get this right this product could be massive as looking forward using a sun cream that could actually repair the cell damage as well as just protect you getting roasted - is going to be a winner- bigger than the Skin & Cell brand IMO

Again Simon said that they are presently working with partners, on a sun cream spray and all he can say at this time is " Its going very well" , laughing out loud and " its very much a watch this space, " as I'm very excited buy this.

My question was answered - which to me was important to hear that its remained the same and was the Q on "full payment on delivery "as to me the actual delivery of the 350k units already received will ensure we hit end of year targets ...with the real possibility of further orders being received European rollout and ramping this up higher before year end.
