The argument they use is that due to COVID they can’t go to the office to perform the requested performance tests and analyses, what a weak argument and if I were a judge I would explain this as simply not cooperative and is this not helping them in having a warm relationship with the judge.

I also noted that the US patent is from 2005, which I think it is not expired, but not 100% sure.

Ordered the document ($4). Maxwell is using. 3 pages to explain that cap-xx should reduce the number of claims from 80 to 20.

The only part with content was this:

The two patents-in-suit are very old and CAP-XX contends that they were first invented as far back as 1998. Both patents-in-suit have been expired since 2019. The patents were previously involved in multiple litigations and disputes, including in this Court.

Not sure how important this expiry is.
