There are clearly many who do not understand or comprehend the brevity of a winding up petitition. The Judge will look at whether the money is owing or not and what steps have been taken by both sides to resolve the matter. If the company have dragged their feet and simply not paid without any valid reason, and bearing in mind that Gowlings have clearly negotiated a settlement for them against Logik, which the company must have agreed upon, then I doubt somehow it's going to go in the company's favour. The brevity is that if a Judge makes a winding up order, that's it, company loses control, official receiver takes over, any assets sold to pay the debt, of which there is likely to be none, and the company is gone. Please look at the link I posted about it.

I ask myself this also, the rns states about 'speculation', that wording is inappropriate, and is it actually FACT, it is FACT that a winding up petition has been issued by the company's own lawyers against them, so to state speculation is absolute balderdash.

Just want to add something here, the petition was lodged at court on 25 October, caseboard have it referenced from memory for that date, and the matter was last active on 27th. In this day and age when proceedings are often allowed to be served by email, I fail to understand how CS states they only knew about it today? Funny that, when they issued an rns this morning isn't it, but didn't include it, don't you think. My view is they hoped to get away without stating anything formal yet again and they've been caught out, but they must have known it was likely to be found!

It's just an utter shambles and I'm glad I'm out. Either the plan now is to let the winding up petition succeed so that will stay the Queeld proceedings and then that will be that, or they pay Gowlings and stop messing about with litigation after litigation which just involves more costs plus further worry and anxiety to shareholders. Queeld and Mispare must be feeling the pressure tonight as there's a danger their case might never be heard. The company says it's looking to obtain legal advice, but I thought Rawlinson was still on board, so why can't he represent them and attempt to get them out of the quagmire and at least save some costs on that front? Anyhow, for what it's worth, I hope folks manage to have a reasonable weekend. GL to the genuine only.

"tough stuff who gets paid" - that's exactly the point, what have the company got to pay with? where is the 108k going to come from? and who is going to give them legal advice knowing full well that they haven't paid their previous lawyers? then look at the upcoming Queeld case, if they get a winding up order made against them, the proceedings will likely be stayed. Think on!

Jeez, what a feeble rns, so they've got themselves in to another mess, because they are refusing to pay 108k and will now have further costs to find for more legal advice, and so it goes on! For how long though?

Interesting that Summit, a veiled threat from you, because that's exactly what IKN said a few times over as well! You and he in the same household by any chance? If the company didn't get itself in to such a mess, then there would be no need for people to comment on it's behaviour, thus, it only has itself to blame. A lot of investors have lost a lot of money through this lot and I can hedge a guess at what has gone on, just the same as cloudtag and 88E, the same common denominator exists, that saw the sp rise and fall, and a few placings happening along the way allowing the companies to raise monies and yet nothing came to fruition!

Oh so you are now a fountain of knowledge Summit on every legal firm in the UK! interesting! Why you have to have a dig at me all the time on here and on greatland is beyond me, but clearly you have some sort of problem. I repeat, lawyers do not like suing their clients, they will do anything to try and avoid it, and this isn't even your standard county court or high court debt claim, it's a winding up petition! If the court hears it quickly, and makes an order against the company, that will effectively be it. If the company get the debt paid, all the better, but my gripe is that yet again, the company should not have allowed matters to get this far out of hand, it's investors that suffer, look at where the sp has ended up today, and it started at 2.7p for you. Speaks volumes.

I have probably dealt with most things thank you Summit. Have you? in a legal capacity? and that was only one of several careers!

By litigation, I mean the High Court Queeld and Mispare case, which is due to be heard in less than a fortnight!

Summit, I was a lawyer, the very last thing you do is issue a winding up petition against your own client, it's virtually unheard of, the problem here though is there are no assets in the UK, so it's been their only option obviously. Yet again, CS has brought the company in to disrepute by allowing this to happen, more litigation, and if they don't settle it quickly, that winding up petition will be made in to an order, and that is likely to be it! There's a part of me that almost thinks the company actually wants it to happen so as to avoid the litigation but thats my view!

Summit, it's the very last resort a lawyer will take against his client, trust me!

Think you need to read this! It's bad enough that the lawyer has had to take such action against it's client, and the lawyer will know that if successful, they'll have no chance of recovering anything hardly, so it must be pretty bad to have got this far!

DP I have put up with so much abuse on here especially from IKN, that I rarely check in now, but I noticed on the left hand side this morning that eurasia was getting fiesty and wondered why, so looked in
