On 13 April 2021, hVIVO, Orph Pharma and Palau Pharma S.A. (“Palau”) executed a Deed of Novation of Contract (“the Novation Agreement”) which transferred to Orph Pharma all of the rights and obligations of hVIVO under a Licence Agreement made between Palau and hVIVO effective as of 27 June 2018 for the development and commercialisation of pharmaceutical products containing certain active agents which are p38 MAPK inhibitors (immunomodulators) including POLB 001 (“the Palau Licence”). The information used in this report was compiled up to 18 June 2022. The information referred to in Section C.3 is up to date as of 11 June 2022. Any change in the status of the patent families discussed below after that date may not be included in this report. Scope of Report This patent report covers certain patent rights owned by Orph Pharma which are relevant to the compound POLB 001, which is a p38 MAP kinase inhibitor indicated for the treatment or prevention of severe influenza. In this respect, the report covers several patent families owned by Orph Pharma, which were recently acquired from hVIVO under the IP Assignment, as well as composition of matter and method of treatment patents owned by Palau, which are licenced exclusively to Orph Pharma under the Palau Licence. The report also covers other patent families acquired by Orph Pharma from hVIVO under the IP Assignment, which relate to Orph Pharma’s PredictViral™ platform of biomarkers for predicting whether a patient is likely to suffer from severe disease and/or be contagious after infection with a respiratory virus such as influenza. The report also relates to a US patent acquired from hVIVO under the IP Assignment, which relates to methods for identifying new peptide-based vaccines against viral infection. As used herein, the terms “patents” and “patent rights”, depending on the context, may also refer to patent applications which have been filed, but not yet granted, or which are unfiled but planned to be filed in due course. A “patent family” means a set of patents and/or applications in different countries which disclose the same or substantially the same subject-matter and have the same filing or priority date (see Section III.5 below). Not included within the scope of this report are certain other patent families which were retained by hVIVO and not acquired by Orph Pharma. In Sections V-VIII below, we have provided a brief summary of each patent family which is owned or in-licenced by Orph Pharma, which summarises the scope of protection afforded or sought under the relevant patents or applications.
