First time I have seen someone take responsibility for producing oil from Sealion
I have been wondering if the delay in the ICSID award being published is actually a deliberate strategy. The attempts by Italy to play the jurisdiction card at least twice might be a perceived threat to the role of arbitration in the Energy Charter Treaty, and self preservation will be uppermost in the minds of ICSID. The last thing they want is a jurisdiction claim going against them.
If the award and its detailed reasons including jurisdiction matters are already decided but only published on the last possible day at the last possible hour, there will be no time for the Italian State to review that and concoct another jurisdiction appeal about it. The process will have timed out.
Equally that suggests that the Claimant RKH has won its case but we won’t know until the last possible moment.

She seems to be an adviser to the State Legal team as a Counsel for the respondant, not an Arbitrator. Maybe her advice is what's holding this up through filibustering as a strategy

Makes sense now. I was looking at latest rules. God forbid 38 (2) comes into play
The latest official position of ICSID is the one published on 25 April 2022......
“The Tribunal declares the proceeding closed in accordance with ICSID Arbitration Rule 38(1).”
However the Arbitration Rule 38 (1) says nothing about closing the proceeding.......
“Rule 38 Witnesses and Experts (1) A party intending to rely on evidence given by a witness shall file a written statement by that witness. The statement shall identify the witness, contain the evidence of the witness, and be signed and dated.”
If the official position is to be believed, it hangs on a witness statement which might be absent. So this could easily roll on to October, which seems to be the ultimate deadline.
What witness statement could be absent? The lost profit calculation or an Italian rebuttal of it? In either case, it must point to win for RKH?

ARG RNS 25 July…
The Company's PL001 Licence currently expires on 31 December 2022. The Company has already advised the Falkland Islands Government of its wish to extend the Licence by a further 2 years.
***A formal application for this Licence extension cannot be submitted before the Falkland Islands Government completes a review of its relationship with the oil and gas sector which is currently underway and expected to be completed in Q3 2022***
RKH RNS 26 July..
FIG has agreed to grant a two-year licence extension to all the licences held by Rockhopper in the North Falkland Basin. Accordingly, the licences will now run until 1 November 2024.

So why is the RKH licence extended for 2 years while the “Government completes a review of its relationship” when ARG licence is not? Either there is a review of the whole SECTOR or there isn’t? Or has it been completed now we are in Q3?
It’s all down to money isn’t it? After the PMO farce, licence awards and obligations will surely have to come with concrete evidence of ability to pay. ARG has not a cat’s chance in hell, whereas the Navitas people will no doubt have shown their hand to get the SL licence extension. And after the recent fundraising so will have RKH.
I don’t think there is any further material impediment to progress with Sea Lion, and I think Nastynick might yet get his wish, he deserves it. It’s just stake building from here, innit?

Fortson was an American reporter on the ST who was on public record as an Argentine supporter. He knew what he was doing. Unfortunately his first scoop about the Liz well being a "duster" was provided by Jungels with a 10% interest who took his call on Sat morning and fessed up for the Sunday scoop.

This kind of news might have caused a feeding frenzy over at ARG, if the share was not suspended. Oh the lost opportunity!
I understand that the Dept of Mineral Resources in FI refer everything to the UK and Kwarsi Kwarteng's lot in Victoria Street, for a second confirmation opinion.
The problem is that Kwarsi has no clue about the oil and gas industry, so he has no opinion, which does not help.
There is only one conceivable explanation. The Italian appointed arbiter is biased and says he wants to provide a minority report, but has done nothing about it, and will ask for the extension to October to finish writing it.
Come October, there will still be no minority report, and he will walk away, to leave the majority report as the Award and Quantum, having pocketed endless cash for doing nothing.
I don't expect a result until October
