From what I have read, the government is fed up with getting into bad reputation following involvement in arbitration so my guess is early settlement cannot be ruled out on this at MARKET VALUE.

The international courts are there for a reason and they will have a final say. The fact that Fascans have got into bed with us on this case makes me believe that they know that our legal case is very very strong and they will have a big team handling this. There will be nowhere to hide if you have legally wronged a company under the bilateral treaty that is so clear in its terms.

"Our focus has now shifted to pursuing a claim against India for breaches of its obligations under Treaty and we have secured the US$13.6 million unconditional funding facility from LCM Funding in support of our claim. The issuance of a Notice of Dispute ("NoD") will be the first step in this process".

I believe the issue of the NoD was to be prior to the end of this year - this being the case, it MUST HAVE been issued today to the Indian govt. This surely must include a statement on what the claim figure will be that will be included IF and when the case is filed with the international courts.

The legal case in my view is very strong and therefore, when the claim figure is announced I expect this to rerate significantly.

Guys - this might create a whole new ball game for PAT as the BJP have replaced Congress in Rajasthan and the national party is the BJP.

With MB's experience in reaching amicable settlements, could the settlement here come very soon - once the Notice is served to the national govt - time will tell but the results of the above election is a move in the right direction and in my view EXTREMELY POSITIVE.

If PAT were to go down this route if offered by the Indian government, I would be very very careful indeed. From what we have seen in their cunning way to change the mining law, what guarantee is there that they will not change the corporate tax law for the gold miners such that they can EXPROPRIATE most of the profits leaving the company completely dry. PAT would again be bound by the laws of the country.

I simply do not trust the govt

How much time PAT will give in its LETTER ( PRIOR TO THE ACTUAL NOTICE) to the Indian authorities to come to to an amicable solution?

Has that letter been already sent? I don't think the sending of the letter will be RNSd.
