They lost the case, not because Maxwell didn't infringe their patents because on some items they did.
They lost it because the patent Cap-xx failed to name the patent inventors correctly.
The patents are invalid now...for whoever.
That's good to know.
Now was that plan B for losing Maxwells licence infringement...OR for Cap-xx losing its patents?
AVX, lexus, CDE will be discussing suing Cap-xx for there money back?
They will certainly not be paying any more licence fees.
So either an appeal or Maxwell buyout for peanuts?

Well, it appears that it was a very poor judgement call by Cap-xx.
Nobody wanted to discuss this scenario but you will have to now.
Cap-xx got greedy....
So did I.....at 4.30 on Friday I knew the risk.
Remember it was Risk v Reward.
On this occasion we are losers.
Where would Cap-xx sp be without this litigation case....
Where's it heading now?
Can we say goodbye to Cap-xx altogether.....that's a strong possibility.
So you bring a valid topic up for discussion and you're branded a troll.

Tesla are suing Cap-xx.
The Alice test is an inspection of the patent and its validity to be granted.
During the Loxus trial this validity would not involve Tesla because Tesla at that point couldn't care less....test passed.
Now Tesla do care and they are saying Cap-xx have infringed their patents prior.
They could be using this to change the Alice test outcome.
Nothing to do with loxus.
What I am saying is now Tesla have been added to the equation.
They are suing Cap-xx for patent infringement.
Are they bringing that tactic forward and using it here to invalidate Cap-xx patents here.
I am sure Maxwells lawyers are not stupid.
Is this an attempt to invalidate Cap-xx patents because they are based around Teslas patents?
Previous cases with the Alice test would not have had this situation in the equation because Tesla was not bothered about them.
What happens to Cap-xx if they succeed?
Yes it might be the same patent.
But they are different products.
Not all supercaps are manufactured the same.
Cap- xx previous infringement cases will be valuable experience.
They will be well aware of what is required to defend their ip...
They will be well aware of what failure would mean to the company and investors.
My money says they know what they are taking on and are confident.
But there's always a BUT!
