That sentence concerns me more. Negotiations shouldn't have to get to "contractual entitlements ". If it comes to KMR v The Government I can only see one winner. Unbelievable that they're ploughing hundreds of millions of dollars/pounds into another project without reaching agreement. The previous agreement expired more than 6 months ago. Any youngster at Uni having to write a thesis on how to continually mess up everything that they do would be well advised to read the complete history of KMR. Unbelievable journey

Saga, 100% correct, a ridiculous piece of accounting although a classic play by the new FD. Get the dirty laundry out right away so "It wasn't my fault ". Doesn't show Mr Hickey in a particularly good light. Maybe MC sowed the seed of doubt whilst doing the DD ???

An interesting "listen". The biggest positive I took from it was when the interviewer asked about the continual huge capital spend over the past 5/6/7 years. Hickey responding that this WCP move should be the last necessary biggy. Would be good to see some stability, sustained profitability and profits retained in the Company therefore increasing the value of the company rather than continually having to spend huge amounts on Projects.

Stock, I hope the variety of answers have given you some insight into how to reclaim DWT. It's easy for anyone to post the link to the Irish Tax Authorities. That gives no help whatsoever. Also, to answer your question, there's no point in communicating with KMR, I tried and their Comms guy bluntly told me they were a mining company not the Irish Tax Authorities. I hope you don't think I'm being unhelpful with my posts. Quite the opposite. By your own admission you were unaware of DWT. No consolation to you nor was I. I've been invested about 6 years when they started paying a divi. That's when like you I realised I'd made a mistake. Still waiting to hear from someone about a success story. Silence......

Stock, I don't think you're being a pain but I don't think tep is being particularly helpful. As with others, he's reading the rules but he hasn't actually confirmed if he has been successful or not. We can all read the ruled. The one thing that I do agree with him is the fact that you will need to involve your broker. Whether that be II or Bell, again my suggestion would be to ask them first. If they won't help you there's no point in thinking about anything else. Others on here have tried asking II and Bell. It would be helpful to you if anyone reading this can let you know if either of these brokers provide this service.

I must have missed teps response. Was he successful in reclaiming his 25% DWT from the Irish Tax Authorities. I guess he can say he was and none of us would be any the wiser. Has anyone ever done so 🤔 😕

Im reading all the different advice you're getting. My advice.... speak to an Accountant. Applying (and getting) a CoR relates to a Double Taxation Agreement with a foreign Country (ROI) through your tax return. Thats assuming you do a tax return as opposed to PAYE. Completely different to reclaiming DWT. I know roughly what I'm talking about but Saga explained it very well some time ago if he can be bothered saying it again. Something like you can offset 10% but not the 25% ????

Apologies Stock, I missed a bit. I think that it's been confirmed by others on here that II won't entertain it. It might be worth you asking them the question before approaching HMRC. If they give you a straight red card then forget it.

Thanks for the congratulations but you are a bit premature. As I said in my post they are processing my claim at the moment. I specifically said that they had not accepted it yet. In other words I have not yet received a bean and my claim might still be rejected.

If you've read my posts from last year you will see that there are several experts on here that tell you how simple it is. A simple question to you - has anyone every confirmed that they have been successful? Greeno was going to try and do it without any documentation from his Nom Co. How did that work out??

Even today Tep1 is critical of Scrafell for giving up. Tep has confirmed to you that you can reclaim if held in an ISA. Did he state that he had successfully done so?? I also previously stated (like Tep) that the Irish Authorities were very helpful. That does not necessary mean that they have parted with any Euros.

I sincerely hope that Tep is correct as the bulk of my holding is in an ISA. My niggling doubt? As part of your claim you have to provide a copy of the tax certificate provided by your custodian. If your holding is in an ISA you won't have paid tax hence you won't have a tax certificate. That's my reading of the rules but I really hope that I am wrong. I am sure that I will find out soon enough.

I've spent over a year working on this. Either I'm not very good at it or as Scrafell says it's a scam and easier to give up - which I won't do just this.

Still waiting to hear from the experts on how successful they've all been.....

My claim started in February 2024 involving my Nom Co, escalating to Financial Ombudsman as a complaint, HMRC and The Iridh Authorities. They advised me 2 weeks ago that they were processing my claim. Please note that doesn't mean that they have accepted it yet. I can update you in due course if you wish.

Should we "run a book" for tomorrow? My bet would be an announcement looking for more time.

Scarfell, also in my opinion, don't put your shares into an ISA. My "humble" reading of their rules are that if you were exempt from paying tax in the UK you're not entitled to claim it back from the Irish Authorities - if that makes sense.

Scarfell, thanks for your response. All the "experts" on here (Cont, Greeno, Saga et al) failed to reply. They all know how to do it but in fact they've never been able to do it,. We can all read the Irish Tax Authorities Rules and Regulations. It's dead simple. NOT. As you say it's a scam. You're quote......

It's a scam, the Irish Gov know it's a scam and are grateful for it. The EU know it's a scam and are looking into it. It puts me off buying foreign shares that have highish dividends.
