Highlights

· Flathead formation gas sample tested 2.5% helium, demonstrating significant helium potential with additional stimulation required to generate commercial flow rates.

· Flathead formation tested 55.2% hydrogen in gas sample isolated from drilling mud, in contrast to formation gas sample tested 0.7% hydrogen.

· Successfully flowed 4,250 thousand cubic feet per day (Mcf/d) of raw gas from the Amsden formation on a 30/64" choke and 1,050 PSI wellhead pressure.

· Amsden formation appears to be a robust gas producer with additional gas analysis underway.

· Absolute Open Flow (AOF*) estimated to be up to 8,000 Mcf/d.

· Charles formation exhibiting strong pressure indications for future stimulated flow testing.

2. Mineral owners have limited options to renegotiate these ironclad contracts. Some could explore the possibility of taking their helium in-kind and marketing it themselves, while others could look to band together to push for change. But with little precedent for successfully challenging these agreements, the outlook is bleak.      

As global helium demand is only expected to rise, addressing this imbalance should be a priority for policymakers. The U.S. can ill-afford to continue letting this valuable national resource be siphoned away at bargain-basement prices.  As it stands, it is a clear impediment to usher in more exploration.  Fairer contract terms would not only provide a better return for stakeholders, but also encourage much-needed investment in helium exploration and production.

Without market forces at play, dysfunction will persist in the helium industry. It's time to level the playing field and ensure mineral owners and taxpayers get a fair shake.

1. The Helium Hustle: How Outdated Contracts Are Costing Mineral Owners and Taxpayers Millions

Global demand for helium is soaring, driving prices to record highs. Yet, many American helium producers are being paid a fraction of current market rates due to restrictive, long-outdated contract terms - and its costing mineral owners and taxpayers dearly.

There is currently no benchmark pricing for helium in the U.S. - a glaring problem that becomes clear when examining the Department of Interior's recent sale of 1 billion cubic feet of the gas for just $70 per thousand cubic feet (“Mcf”). This rock-bottom price represents a dysfunctional market at its finest.  Final approval of the sale by the Department of Justice is pending. 

Many working interest and royalty owners are locked into old purchase agreements that vastly undervalue their helium. Pay stubs show some producers receiving around $100 per Mcf – a severe discount to current market rates. Mineral owners are left with little choice but to accept these below-market terms.  Would you drill a well for helium knowing that you would only get $100 per Mcf?  No.  Antiquated pricing in contracts discourages investment. 

The issue is compounded by the fact that a significant portion of this underpriced helium is produced from federal lands. These outdated contracts are costing the U.S. government and taxpayers tens of millions annually in lost royalties, effectively subsidizing major corporations at the public's expense. State land offices also stand to lose out as this trend continues.
