OPINION on the application for
a mining concession, Kallak NO. 1 In Jokkmokk
Case No. N2017-04553-FOF
as Agents for J�hk�gasska Tjiellde ( "Sami village") and on the occasion of the County Administrative Board
of Norrbotten County ( "Administrative Board") opinion on the matter November 30, 2017, we hereby
make the following.
1 sameby SETTING
1.1 sameby parts County Administrative Board's opinion that the application for
a mining concession shall not be granted, and agree with the County Administrative Board
stated,inter alia, the impact on reindeer husbandry, Swedish Lapland and in terms of
national interest balance.
1.2 Each district believes that the County Administrative Board's assessment is well founded and in
accordance with applicable law and the legislator's intentions, why the government
should put the County Administrative Board's opinion the basis for its decision.
2 County Administration OPINION
2.1 The board has at its application environment of the beam ( "MB") and on
examination under Chapter 3. refers in particular to the Govt. 1985/86: 3, which states
that:
"national interest herding should be seen in a landscape perspective because it is a protection for
areas with different purposes, which must be related to the whole to function, so-called
functional relationships. This means that there must be basic conditions for
the reindeer industry in virtually every sameby, namely secure access to such areas

in both season areas and winter pastures that are crucial for
theprospects of reindeer herding. "
2.2 The board has therefore put emphasis on the functional relationships that must exist
in reindeer husbandry. The board has also considered that the above
preliminary work also shows that reindeer husbandry is a prerequisite for the Sami culture
and the national interest protection of the reindeer were added because of the reindeer
difficulties to assert itself against the powerful development interests in the reindeer herding area.
2.3 Reindeer husbandry is not only a trade or business, but it is culturally significant. Each district
would refer in this respect to the Sami village's opinion of 30 August 2013,
which the Sami village explained how reindeer herding culture-bearing function raises
questions of constitutional rights and Sweden's international commitments.
2.4 In addition, the board has taken account of the site for sameby - to constitute a
core region comprising functional connection for reindeer with
multifunctional features. This account is in good agreement with the above
