previoulsy i think there is higher chance for indivior to settle with doj "amicably"...now i think there is higher chance that this case being thrown out of court, becuase if doj settles with indivior, the public might still finger pointing "you shall not let criminals go for monies". if court throws out the proceeding, doj will say, you see, it is court decision, not my decision..you blame court, anyhow i got usd 1.4 b for government, isnt that still a big sucess? will review this prediction in 3 months time..

All possible. I guess it is also related to GBP v. USD...look at FTSE100 today. the company indivior valued in GBP but earns USD mainly - now GBP down substantially, USD up hugely, the GBP price tag for the company should increase proportionally (assumption other factors no change)
personal opinion and prediction to DOJ settlement timing: according to demerger agreement published online, indivior and RB has a mutual hold harmless clause or mutual warranty clause. put it simple, RB need pay indivior legal claims due to RB fault, and vice versa. Generally legal claims refer to court adjudged claims, not payment under settlement agreement with third party. if court judged against indivior for what RB has done before demerger, due to RB fault, usually Indivior can claim against RB. It is unthinkable that RB gives a whopping 1.4B without reference to solutions in the Doj v. Indivior for RB pre-demerger activities . Since Doj cornered Indivior for 3B, and indivior has no big assets like RB to satisfy DOJ, indivior has no other chance but to fight in court (also outside legal counsel also says lets fight against the bastard). Now DOJ or government got 1.4B, basically or largely the problem is solved or target of government reached, legally, commercially and most importantly politically. Doj need a ladder to stepdown the play or the theater stage. If directly settle now, it might be a little bizzare - when Doj filed proceeding in April, you can sense the Doj cannon firing and public is moblised to criticize Indivior and RB. Now public knows Indivior said to court " you have a such a weak case, that it should be threw out of the court, and the prosecutors should be punished (with prejudice), seems to me Doj has found the ladder to stepdown. that said, it would be no surprise if there is a settlement agreement anytime from now on. will review this prediction after 3 months.

this is not lethal to indivior:
1. legally indivior can challenge fda decision in the future. the legal process is so complicated, that it may easy to fight to the end of 2020. indivior said "i will assess", means no fda decision yet..if decision out, indivior may challenge. of course, indivior may elect not to challenge for pr or commercial considerations. similar when court said dr not infringed, indivior can appeal furthur, but for pr reasons, not to go for this (it will add resentment even if legally indivior has grounds)
2. market first come wins all effect, such as qwertly keyboards or google. it is difficult for people to change habits esp these brain receptor related drugs
3. no gurarantee new comer is good or cheap. market is increasing for sublocade or similar drugs if you try to avoid suboxone misuse (sublocade avoid misuse)

1. indivior lost court battle to dr reddy. some people think this is bad news. i think this news is neutral., if not a good one. on one hand, it affirms indivior patents, on the other hand it implies dr reddy product is not same (not 1 to 1 copy). Waston infringed, but was blocked until 2024.
2. RB settled 1.4B, on grounds of "no wrongdoing". this take out vast majority of DOJ v. Indivior battle grounds. (also jeopardize class claims in securities etc). it is more practical for DOJ to try to settle with Indivior, other than continue a battle where majority of their grounds are taken out. continue the court battle v. settlement asap. I estimate settlement asap has more chance.
3. As to possible settlement figure, since DOJ already got 1.4B for their 3B claim, any contribution from Indivior is a success for DOJ. unlikely DOJ now still open a lions mouth, considering Indivior is a major player in opiod treatment market, and any legal loss will "taint" their current success of 1.4B from RB

my understanding: INDV lost injunction proceeding (case 1). the injunction proceeding is aimed at blocking Dr. Reddy to launch generics. INDV placed counter security. now INDV lost the injunction proceeding, Dr. Reddy can launch generic. however, INDV has another proceeding (case 2): patent dispute. INDV lost in first court proceeding, now the case is under appeal. If INDV lost patent dispute in the end, INDV need pay Dr. Reddy some USD 74M or so. If INDV won the patent dispute, Dr. Reddy need pay INDV (this is what " at risk" mean)
your understanding being INDV lost (you assumed the case 2 in above situations). that is incorrect. you can check with your solicitor relative to see.

Replying to a query, he said the Indivior Plc which tried to block Dr Reddys launch of generic suboxone in the USA through legal battle posted a bond of $72 million to cover Dr Reddys potential claim of lost profit while the injunction was contested in the US courts.
Dr Reddy's relaunched its buprenorphine and naloxone sublingual film, the generic version of suboxone in the USA market in February 2019 at risk. Indivior unsuccessfully contested in courts on the launch of Dr Reddys drug. The matter is still pending in court. Prasad said they would ask more than USD 72 million if the final verdict comes in their favour.
