Joint STIPULATION TO EXTEND TIME to file the Pre-Trial Order to August 29, 2022 - filed by CAP-XX, Ltd.

NOTICE OF WITHDRAWAL

On July 15, 2022, Plaintiff CAP-XX, Ltd. (“CAP-XX”) moved for Summary
Judgment on Defendant Maxwell Technologies, Inc.’s Affirmative Defense and
Counterclaims of Inequitable Conduct (D.I. 143) (the “Inequitable Conduct
Motion”). On August 9, 2022, the parties filed a stipulation (D.I. 187) dismissing
with prejudice Maxwell Technologies, Inc.’s Ninth Affirmative Defense and Fifth
and Sixth Counterclaims, which were related to its claims of inequitable conduct.
On August 10, 2022, the Court so ordered the stipulation of partial dismissal (D.I.
188). Consequently, CAP-XX withdraws its Inequitable Conduct Motion.
