Think this is incorrect, FDA did not encourage but have demanded another trial. Otherwise why would the company be spending potentially millions..just to satisfy the FDA’s wish?

13.we need to remember that the fda did not reject the nda or Iclaprim but encouraged motif for another trial before approval so I read this as they wanted it to be approved but more data is required to be sure of potential liver toxicity.

Have to agree with this as it’s a no brainer. BoD not buying makes one wonder and would be seen as red flag to majority of investors..

You have to remember FDA won’t meet until they submit their proposal design, this is what they’ve agreed to. Then they will be at least 4 weeks for FDA to review, and then a further meeting to hopefully finalise the trial. Until they have this trial design they want be able to secure any funding, apart of heavily discounted placing to keep the lights on.

As a result of the Company's continued financing of HEPI, as of 30 June 2019, HEPI owed the Company approximately US$124 million by way of an intra-group debt ("Intra-Group Debt"). As part of the Transaction, the Company proposes to (i) capitalise substantially all of the Intra-Group Debt as at the date of completion of the Transaction ("Completion") in consideration of the issue by HEPI of further shares in HEPI; and (ii) waive its rights to the repayment of the remainder of Intra-Group Debt such that the remainder of Intra-Group Debt will be written off and HEPI will not have any indebtedness to the Company following Completion ("Capitalisation and Waiver"). This means that the Intra-Group Debt will no longer appear in the Company's financial statements. In the event that Completion does not occur, the Company will not proceed with the Capitalisation and Waiver and the Intra-Group Debt will remain outstanding.

This is hugh news here, when you consider they’ve been going round in circles with the Indian courts! It’s been some 8years just waiting to enforce a ruling which could easily take another 8 years!

Have you seen the monumental losses there, best thing bod have done. They’ve cut their losses..and can move on.
