Thanks RMM, the transcript of the appeal hearing is on the USPO website accessed via the patents tab on the Sareum site...as you say, it looks like Ms Fredericks wasn’t able to convince the judges!

Late breaking data submission deadline was March 14, notifications sent to authors March 29. Sierra should know by the end of this week whether the abstract has been accepted so likely we'll see a further RNS in the near future.

At the AGM JR stated 'We haven’t definitively decided which autoimmune disease to target so that will be driven by what our competitors bring up in the clinic and the results if the experiments that we are doing on our molecule and those experiments are in progress.
He went on to say ' SRI have been involved in all of the autoimmune disease aspects of the programme so that have looked at 1801 and 1802 in their experiments, I think they are focussing wholly on lupus research at the moment…they have done some tests on 1801, they have not looked at 1801 in their lupus model though as it happens so they have looked at other molecules in their lupus model, they got a grant from the department of defence specifically to focus on that, you will be aware they put out an interim report that showed some promising data however they have not finished their studies yet. So we are really waiting for them to complete that before we put out our press release on the lupus data'
JR further stated that 'SRI have the potential to contribute to the pre-clinical development however I don’t think they have the funding at the moment to do that so we are pursuing that by ourselves at the moment'.
So it appears that we are not reliant on SRI for progressing 1801 in lupus and Thoth2's assertion that we are waiting on others to show their hands could well be correct. All IMHO, DYOR etc

Thoth2, what’s your take on the abandonment of the patent appeal and the continuing application. In the absence of a successful appeal is this not just the finalisation of the US patent cover?

The filing date of the 'abondonment' 1st March was before the hearing date of 7th March which begs the question as to whether the hearing took place? What is the confirmed priority date?

Agreed on this, no evidence thus far that Parker in particular has added any value whatsoever.

After further digging

Appeal filed 6/5/2016 - as per below 'decision typically around 30 months from start of appeal' i.e. outcome already 4 months overdue.

Board Decision

The PTAB will issue a decision typically around 30 months from the start of the appeal. There are several possible outcomes including a remand, new grounds of rejection by the Board, reversal of the Examiner’s rejection or affirmance of the rejection. If the appeal is determined in the Examiner’s favor, the applicant has 63 days from the mailing date of the decision before the application is abandoned. During this period, the applicant may file a request for continued examination or a continuing application and claim priority to the original application.
