Mark the simple way I understood it at the time was after being naive Mtb asked everything Fda wanted. The tests done patients sent home. The Fda sometime later say the want more toxicity results but too late. As we know the liver does repair itself but without the original patients kept available to test there was no chance of that happening. So it was not a fail just further testing. Now it will cost a lot of money to redo but it did not fail. Mtb made it clear they would do all Fda asked at time of testing but Fda did not want to hold Lumsdens hand throughout the process and the bod at that time were not up to the job. There are far more intelligent people on this forum that can make my statement clearer or shoot it down but being an Lth this is how I remember it at the time.
