Pre trial settlement perhaps, but court awarded damages would be based on the proved infringed claims. In my opinion Nanoco should take them all the way, win substantial damages, then entertain a global settlement from an extremely strong negotiating position.

The patents will be substantially upheld with only some of the claims possibly invalidated. Then on to the court proceedings which WILL NOT be delayed on the basis of a PTAB appeal, to litigate the strongest most unequivocally-provable infringed valid claims.

It's as simple as that.

It was the prospect of an imminent injunction on sales in Europe that to a considerable extent contributed to the Apple/Qualcomm patent dispute settlement.

Still remains an option and likely the next phase in the litigation process if no settlement.
