Apologies, I should check my facts before posting. The FCA handbook - CONC 4.5 Commissions: credit brokers, clearly states ' a credit broker must prominently disclose to a customer in good time before a credit agreement or a consumer hire agreement is entered into, the existence and nature of any commission, fee or other remuneration payable to the credit broker by the lender or owner or a third party, where the existence or the amount of commission, fee etc... could
1). Affect the impartiality of the broker
2). Have a material impact on the customers transactional decision
I'm not sure how anyone can quantify the liability based upon the above until a decision has been ruled by the courts. Until then it is pure speculation.
